I estal ilishes that the Final Repayment Obligation is in excess of any payments made by the State <br />2 tow, rd the Estimated Repayment Obligation of $36,214,474 the State will have the option to pay <br />3 the ipmaining balance of the Final Repayment Obligation 180 days from the date of written <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />After the 180 -day final payment option established in Article 7(f) has expired, the <br />unp id portion of the Final Repayment Obligation shall become the Remaining Repayment <br />Obli ation of the State. The United States will assign that Remaining Repayment Obligation, on <br />a pr ( rata basis, to a portion of the State's Project allocation, subject to the procedures of Section <br />6(a) 3)(B) of the Settlement Act, as amended. The formula to determine the portion of the State's <br />Proj ct allocation that this Remaining Repayment Obligation will be assigned is as follows: <br />ning <br />t Allocation = (Final Repayment Obligation - Repayment Received) <br />-ing Final Repayment Obligation <br />ment <br />x <br />10,440 <br />Acre - <br />Feet <br />13 The ibove calculation to identify the Project allocation assigned to the Remaining Repayment <br />14 Obli 3,ation will be rounded to the nearest whole acre -foot of storage. <br />15 ) Upon final cost allocation, if the State elects not to pay the Remaining Repayment <br />16 Obli ration to the United States for the remaining Project allocation (including storage) described <br />17 and alculated in Article 7(g), then this portion of the State's Project allocation shall be subject <br />18 tot procedures of relinquishment as specified by Section 6(a)(3)(B) of the Settlement Act, as <br />19 <br />20 ) It is agreed that during construction every attempt will be made to keep Non - Contract <br />21 Cos at or below 30 percent of the final contract costs.
