I (b) he Project Operations Committee consisted of representatives from those entities that
2 were idei tified by the Settlement Act, as amended, to receive a water allocation and the Bureau
3 of Recla ation. This committee determined an appropriate entity to contract with Reclamation
4 for the o eration, maintenance, and replacement (OM &R) of the Project Works :and developed a
5 commol understanding among the project beneficiaries of the appropriate level of annual
6 OM &R ictivities to be performed on the Project Works to assure the Project's long term
7 operati al integrity and public safety. This committee was essentially replaced by the
8 Assock Lion who subsequently entered into an OM &R contract with Reclamation. Ultimately,
9 the Ass ciation will oversee the ongoing OM &R activities of the Project Works, providing
10 consul tion and coordination among Association members on such items as annual OM &R
1 l fundin , maintenance schedules, and public safety issues.

13 4. MEASUREMENT AND RESPONSIBILITY FOR DISTRIBUTION OF STATUTORY
14 WATER ALLOCATION
15 (a The water released or bypassed for the State pursuant to this contract shall be measured
16 at the utlet works of Ridges Basin Dam, and /or in the Animas River at the Durango Pumping
17 Plant ith measuring facilities installed by the United States as a part of the Project. Additional
18 point of diversion directly from Lake Nighthorse may be made in the future by the State after
19 cons ltation and approval of the United States. Water delivered at these additional points of
20 divei sion on Lake Nighthorse shall be measured at those points of diversion by facilities
21 provpded by the State or its subcontractors. Water will be available at the outlet works of Ridges

Dam and /or the Animas River in such quantities as the State determines, subject to
ty limitations of the relevant facilities, to ensure that the State annually; receives a
