ALPOM&R Association <br />November 5, 2012 Board Meeting Minutes <br />(11/20/12 — Draft —v2) <br />Animas La Plata Operation, Maintenance and Replacement Association <br />Minutes for November 5, 2012 Meeting which was held at 12:42 PM <br />in the ALP OM &R Office Conference Room, 125 Smelter Place, Durango, Colorado <br />1. Call to Order /Review Agenda <br />12:42 PM —The meeting was called to order by Chairman Jason John. ALP Office Manager, Carly <br />DeLong called the role. The Chairman declared a quorum was established. <br />Association Board members present were: Manuel Heart, Randy Kirkpatrick, Lena Atencio, Jason John, <br />Charles Blassingame, and Tim Feehan. Mike Brod was present by conference call. Alternates present <br />were: Celene Hawkins, Aaron Chavez, and Scott McElroy. Other participants were: Jennifer Hunt, Ryan <br />Christianson, Jack Rogers, Liz Taylor, Mark Chiarito, Ron LeBlanc, Barry Longwell, Tyler Artichoker, Greg <br />Hoch, Vicki Vandegrift, Gregg Boysen, Cathy Metz, Bruce Whitehead, Bob Wolff, David Smith, Amy Huff, <br />Kathleen Ozga, Russ Howard, Tom Miller and Carly DeLong. <br />Manual Heart made a motion to move Item 7, Annexation of Reservoir, to the first topic of <br />discussion. Randy Kirkpatrick seconded the motion. Voting yea were: Manuel Heart, Randy <br />Kirkpatrick, Lena Atencio, Jason John, Charles Blassingame, Mike Brod and Tim Feehan. The motion <br />passed. <br />2. Annexation of Reservoir <br />Kathleen Ozga, Bureau of Reclamation Land and Recreation Group Chief Western Colorado Area Office, <br />attended the meeting to discuss the Annexation issue. She reported the BOR is in the process of <br />negotiating a Recreation Lease Agreement with the City of Durango to be the BOR's recreation partner <br />so that the Lake Nighthorse facility can be opened to the public about one year from now. Kathleen <br />further reported the BOR looks for the capability of law enforcement as part of the recreation <br />partnership. The BOR usually has agreements with State Parks who can provide the law enforcement <br />element. If the City were to manage recreation without annexation, the Sheriff's Department would <br />provide the law enforcement capability for the Lake Nighthorse area; however, the Sheriff's <br />Department resources are spread very thin. If the City of Durango annexed the Lake Nighthorse area, <br />the City could provide the law enforcement capability to the Lake Nighthorse area. The BOR has not <br />decided to go forward with the annexation as of yet; today's meeting is an opportunity to discuss the <br />pros and cons of annexation. Further, the first part of the process is for the BOR to submit an <br />Annexation Application to the City of Durango, if that is accepted by the City, then the BOR would <br />negotiate an Annexation Agreement with the City which lays out the various terms and conditions and <br />which could address and alleviate the concerns of all parties. <br />Cathy Metz, City of Durango Recreation Director, stated representatives of the City are present in <br />today's meeting to hear the Association's perspective and concerns. Greg Hoch, City of Durango <br />Planning Director, reported the City Council's consideration is subject to two processes; an <br />informational public meeting and a public Planning Commission meeting. The first informational public <br />meeting is scheduled for this Thursday, November 8, 2012 and is required to put the Lake Nighthorse <br />property within the Comprehensive Plan boundary. The City Charter requires any land to be annexed <br />also be in compliance with the Durango Comprehensive Plan. At this point in time, the City's <br />Comprehensive Plan does not encompass the Lake Nighthorse area. The City staff proposes that the <br />process to add the Lake Nighthorse area to the Comprehensive plan could take place in <br />November /December of this year and then once the Comprehensive Plan is amended the formal <br />annexation process could start, however, it will not start unless there is a petition submitted by the <br />BOR that initiates the process. The formal annexation process would then entail two public hearings; <br />one with the Planning Commission and one with the City Council. Before the City Council decides <br />Page 1 <br />
