1 <br />r* <br />E. subject to approval by the city attorney, <br />preparation of documents required to discharge or hold <br />harmless the City and its officers and employees from <br />liability under.a claim; and <br />F. standards for compromising and settling <br />claims brought against the City or its employees or <br />officials. <br />4.18.070 Litigation. A. Pursuant to the <br />requirements of t e Greeley City Charter and Chapter <br />2.16 of this Code, the city attorney shall have the <br />responsibility to represent the City, and its officers <br />and employees, as applicable, in connection with all <br />litigation arising under claims brought pursuant to <br />this Chapter 4.18. <br />B. The city attorney, or his duly authorized <br />assistants, shall have the authority to settle liti- <br />gated claims up to five thousand dollars ($5,000.00). <br />Settlements beyond five thousand dollars ($5,000.00) <br />but less than fifty thousand dollars ($50,000.00) shall <br />require the prior approval of the claims review board, <br />and settlements over fifty thg4n dollars <br />($50,000.00) shall require.�tbe:�pr, approval of City <br />Council; provided, however, that- nothi� herein shall <br />preclude the city attorney►, An'yhisT'A 141oeb sdte� ion, from <br />presenting an such settlement f�`, of amount, <br />P 9 y � %, g, <br />directly to the City Counci -� ak . pp"val. <br />C. The city attorney }sh'ah Have the power to <br />authorize requests to the `s=ritsk manager for disburse- <br />ments from the claims rerve fund or such other <br />appropriate accounts in connection with litigation <br />expenses, including but not limited to, outside counsel <br />fees, defense costs, expert witness fees, and pre- <br />paration of such demonstrative evidence which is <br />necessary to properly and reasonably defend the City, <br />its officers and employees in connection with said <br />litigation. <br />D. The city attorney shall have the authority to <br />contract for outside counsel in connection with <br />litigation arising out of claims brought pursuant to <br />this Section 4.18, and may request disbursement from <br />the claims reserve fund or such other appropriate funds <br />as set forth in Section 4.18.070C above. <br />E. In addition to a quarterly litigation report, <br />the city attorney shall be responsible for providing a <br />litigation settlement report to the City Council and <br />the risk manager for all cases which have been settled <br />without the prior knowledge of City Council pursuant to <br />the requirements of this section. <br />--7- <br />113 <br />
