<br />WHEREAS, pursuant to the provisions of 37 -60 -119, Colorado
<br />Revised Statutes, the State is authorized to loan money for the
<br />construction of water projects for the benefit of the people of
<br />the State; and
<br />WHEREAS, the Contractor is a duly constituted Home Rule City
<br />in the State of Colorado and wishes to construct, or cause to be
<br />constructed, the enlargement and rehabilitation of its Peterson
<br />Dam and appurtenant structures, hereinafter called the project,
<br />which is located in Larimer County, Colorado at an estimated cost
<br />of Seven Hundred Sixty Thousand Dollars 000); and
<br />WHEREAS, the State participate' as
<br />investigation of said project, and i'w fo t, such a

<br />WHEREAS, the State has now agreed to loan money for the
<br />construction of said project upon mutually agreeable terms and
<br />conditions, subject to the availability of funding for that
<br />purpose; and
<br />WHEREAS, pursuant to Senate Bill No. 15, Fifty -Sixth General
<br />Assembly of the State of Colorado, duly enacted into law, the
<br />State has been authorized to loan a sum not to exceed Three
<br />Hundred Eighty Thousand Dollars ($380,000) for the feasibility
<br />report and the construction of the'project;
<br />WHEREAS, the Contractor desires to include the repayment of
<br />the sum of Twenty -Three Thousand Six Hundred Forty Dollars
<br />($23,640), previously advanced by the State for the feasibility
<br />study of Peterson Dam, in its repayment of the loan of Three
<br />Hundred Fifty -Six Thousand Three Hundred Sixty Dollars ($356,360)
<br />made under this contract for a total principal repayment of Three
<br />Hundred Eighty Thousand Dollars ($380,000);
<br />NOW, THEREFORE, in consideration of the mutual and dependent
<br />covenants herein contained, it is agreed by the parties hereto as
<br />follows:
<br />A. The Contractor agrees that it shall:
<br />1. Employ an engineering firm to prepare project plans and
<br />specifications for the project. Both the engineering firm and the
<br />project plans and specifications must be approved by the State
<br />before initiation of construction on the project, including any
<br />real estate and water rights acquisitions, can commence.
