AGENCY NAME: Water Conservation Board <br />AGENCY NUMBER: PDA <br />ROUTING NUMBER: /�, i <br />CONTRACT AMENDMENT NO. 2 <br />This Amendment, made this 11' day of February 2000, by and between the State <br />of Colorado for the use and benefit of the Department of Natural Resources, Colorado <br />Water Conservation Board, hereinafter referred to as the CWCB or STATE, and City of <br />Greeley, Colorado, hereinafter referred to as the CONTRACTOR. <br />Factual Recitals <br />A. Authority exists in the law, and funds have been budgeted, appropriated, and <br />otherwise made available and a sufficient unencumbered balance thereof remains <br />available for payment in Fund Number 424, Organization YYYY, Appropriation Code <br />362, Program WTRC, Contract Encumbrancallw6mber C153618A. <br />B. Required approval, clearance, and c h �n accomplished from and <br />with appropriate agencies. Y'd -4 <br />C. The STATE and the CONTRACTOR ter contract dated July 17, 1992, <br />amended March 13, 1995, Contrac cu rance Number C153618, hereinafter <br />referred to as ORIGINAL CONTRACT, ' rated herein by reference, wherein the <br />STATE agreed to loan money in the t amount up to $644,236, for construction of <br />the Project and the CONTRACTOR agreed to repay the loan in accordance with the <br />terms of the ORIGINAL CONTRACT. <br />D. The State and the Contractor entered into a contract dated July 1, 1986, Contract <br />Encumbrance Number C153467, wherein the State agreed to loan money to the <br />Contractor in the total amount of $68,560 to help finance the cost of preparing <br />feasibility studies for three water projects contemplated by the Contractor: $26,640 for <br />the Comanche Dam feasibility study, $23,640 for the Peterson Dam feasibility study <br />and $18,280 for the Twin Lakes feasibility study. As each Project was constructed, <br />the cost of the feasibility study was to be combined with the loan to cover the cost of <br />constructing the project. <br />E. The feasibility study cost of $23,640 for the Peterson Dam project was combined with <br />the construction loan in the amount of $620,596 for a total loan amount of $644,236. <br />F. An audit of the contract revealed that the Contractor used only $19,340 of the $26,640 <br />available, and therefore, the amount of the loan should be reduced by $4,300 for an <br />City of Greeley Page 1 of 3 Contract Amendment No. 2 <br />
