E� ti (R 5/85) �::S //rl'y <br />[6FPAR NP OR AGENCY NUMBER <br />34 -04 -00 <br />CONTRACT ROUTING= NUMBER <br />No additional encumbrance <br />FEASIBILITY REPORT <br />CONTRACT AMENDMENT <br />THIS CONTRACT, made this day of 198 , by and between the <br />State of Colorado for the use and benefit of the Department of '� atural Resources <br />(Colorado Water Conservation Board), <br />hereinafter referred to as the State, and 'Z the City of Greeley, <br />Civic Center Complex, 919 7th St., Greeley, CO 80631, <br />hereinafter referred to as the contractor /Contractor. <br />WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made <br />available and a sufficient unencumbered balance thereof remains available for payment in Fund Number 4 0 0 8 <br />G/L Account Number 5274 X, Contract Encumbrance Number C 15 3 4 6 7; and <br />ABL Account Number 12740, Org. Unit 77 -77 -777, <br />WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate <br />agencies; and <br />WHEREAS, a contract was entered on July 1, 1986, <br />Contract Encumbrance Number C15346 Or,Val Contract), <br />between the State and the Contrg,.R nd <br />WHEREAS, the Original ContrJ;" pr that the State <br />would pay fifty percent (50 %) of the n for the Contractor to <br />conduct feasibility studies for t1 re° bilitation of three <br />dams; namely, Comanche Dam, Petelt �0 aDam and Twin Lakes Dam. <br />xr r . <br />Fifty Percent (50 %) of that cost,''gr Sixty -Eight Thousand Five <br />Hundred Sixty Dollars ($68,560), as shown by Exhibit B of the <br />Original Contract; and <br />WHEREAS. Paragraphs 5. and 6. of the Original Contract <br />provided that the Contractor would repay the State Eighty -Eight <br />Thousand Seven Hundred Eighty -Five Dollars and Twenty Cents <br />($88,785.20) in ten (10) equal annual payments of Eight <br />Thousand Eight Hundred Seventy -Eight Dollars and Fifty -Two <br />Cents ($8,878.52) each if the rehabilitation of the three dams <br />was initiated within ten (10) years of the effective date of <br />the Original Contract; and <br />WHEREAS, the repayment provisions of Paragraphs 5. and 6. of <br />the Original Contract were intended by the parties to apply in <br />a proportionate cost amount to any part of the three dam water <br />projects, as long as the rehabilitation of such part is <br />initiated within the specified time; and <br />WHEREAS, the total repayment to the State of Eighty -Eight <br />Thousand Seven Hundred Eighty -Five Dollars and Twenty Cents <br />($88,785.20) was derived by adding a five percent (5 %) per <br />annum service charge to the fifty percent (50 %) State payment <br />of Sixty -Eight Thousand Five Hundred Sixty Dollars ($68,560) <br />for preparing the three feasibility reports, which fee is shown <br />in Exhibit B of the Original Contract; and <br />WHEREAS, the Contractor desires to enter into a Project <br />Contract with the State at this time to proceed with the <br />rehabilitation of the Comanche Dam only. The initiation of <br />this Comanche Dam rehabilitation would activate the repayment <br />provisions of Paragraphs 5. and 6. of the Original Contract for <br />repayment by the Contractor to the State of a proportionate <br />cost amount provided by the State for the Comanche Dam; and <br />WHEREAS, the proportionate share of the Eighty -Eight <br />Thousand Seven Hundred Eighty -Five Dollars and Twenty Cents <br />($88.785.20) for the Comanche Dam feasibility report is <br />Thirty -Four Thousand Four Hundred Ninety -Eight Dollars and <br />Eighty Cents ($34,498.80).
