<br />THIS CONTRACT, made this 15th day of September , 1982, by and between the
<br />State of Colorado for the use and benefit of the Department of '1 Natural Resources
<br />(Colorado Water Conservation Board), -
<br />hereinafter referred to as the State, and '2 the Terrace Irrigation company,
<br />P. 0. Box 667, Monte Vista Colorado 81144
<br />hereinafter referred to as the contractor,
<br />WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made
<br />available and a sufficient unencumbered balance thereof remains available for payment in Fund Number 4 0 0 8
<br />G/L Account Number 5 314 X , Contract Encumbrance Number--Cl-5-13-32- and
<br />ABL Account Number 13140, Org. Unit 77 -77 -777,
<br />WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate
<br />agencies; and
<br />WHEREAS, the Contractor and the State have entered into a
<br />contract numbered C- 153332, dated September 15, 1980, which states
<br />specific terms and conditions, and which is. included as Exhibit A;
<br />and
<br />WHEREAS, the Contractor by letter dated September 14, 1982,
<br />incorporated as Exhibit B, has reduced the State obligation by
<br />Twelve Thousand Dollars ($12 00 )
<br />NOW THEREFORE, amend the r ontract to read:
<br />1. All references t H w U Thousand Six Hundred
<br />Dollars ($620,600 u to read Six Hundred
<br />Eight Thousand S' d ar ($608,600) as appears on
<br />page one of the original contract.
<br />2. Change paragraph 9, page 2, to read:
<br />To purchase from the State all of the state's rights,
<br />title, and interest in said project and any facilities
<br />thereof at a total purchase price of One Million
<br />Fifty -Two Thousand Nine Hundred Fifty -Five Dollars and
<br />Eighty-Eight Cents ($1,052,955.88) payable in forty (40)
<br />annual installments, which the first installment shall be
<br />Twenty -Six Thousand Eight Hundred Forty -Seven Dollars and
<br />Sixteen Cents ($26,847.16) and the succeeding thirty -nine
<br />(39) installments shall be Twenty -Six Thousand Three
<br />Hundred Ten Dollars and Forty -Eight Cents ($26,310.48).
<br />each, which installments shall be due and payable on
<br />September 1, 1982, and yearly thereafter until the entire
<br />principal sum shall have been paid. Said installment
<br />payments shall be made payable to the Colorado Water
<br />Conservation Board in Denver, Colorado.
<br />3. Change the monetary amounts as stated in paragraph B(1) ,
<br />page 2, to read: Six Hundred Eight Thousand Six Hundred
<br />Dollars ($608,600).
<br />4 Change the monetary amounts as stated in paragraph B(4),
<br />page 31 to read One Million Fifty -Two Thousand Nine
<br />Hundred Fifty -Five Dollars and Eighty -Eight Cents
<br />($1,052,955.88).
