<br />TERRACE IRRIGATION COMPANY, whose address is 924 First Avenue, Monte
<br />Vista,,Colorado, 81144, County of.Rio Grande, and State of Colorado, for the
<br />consideration of Other Good and Valuable Considerations and TEN AND N01100
<br />DOLLARS ($10.00), in hand paid, hereby, sells, and conveys, to the COLORADO WATER
<br />CONSERVATION BOARD, DEPARTMENT OF NATURAL RESOURCES, STATE OF COLORADO, whose
<br />address is 1313 Sherman Street, Denver, Colorado, 80203, County of Denver, and
<br />State of Colorado, the following real property, in the County of Conejos, and
<br />State of Colorado, to -wit:
<br />(a) A steel pipe, 5/16 inch.thick, 48 inch diameter 26.9+ feet long,
<br />inside the existing reservoir rock.outlet tunnel; and,
<br />(.b) A 42 inch. diameter ring jet throttling valve, connected to the
<br />r downstream end of the pipe described under (a); and,
<br />Jam' (c) Appurtenances,and controls necessary for the operation of the
<br />system as described in (a) and (b); and,
<br />(d) Two 48 inch diameter reservoi o` gate valves- (repaired),
<br />located at the outlet wor is i. d m.
<br />with all its appurtenances, and warrants . e° same.
<br />This Deed is made in accordant- t certain Contract heretofore
<br />entered into on the 15th.day of Septemrj 80, by and between the State of
<br />Colorado for the use and benefit of the,. partment of Natural Resources (Colorado
<br />Water Conservation Board) and TERRACE IRRIGATION COMPANY, and in accordance with.
<br />Colorado Revised Statutes, 1973, 37-60-120; PROVIDED HOWEVER, that upon repayment
<br />of funds as called for in the Contract dated September 15, 1980, as the same were
<br />made available by Colorado Revised Statutes, 1973, 37-60-119, the State.of Colorado
<br />shall reconvey said property to the Grantor herein..
