urm 6- AC -02A DE -MENT OR'AGENCY NUMBER <br />-4-04-00 <br />CONTRACT ROUTING NUMBER <br />EXHIBIT A q0 20 <br />CONTRACT $620,600 <br />THIS CONTRACT, made this 15th day of September —1982., by and between the <br />Slate of Colorado for the use and benefit of the Department of '� NATURAL RESOURCES <br />(Colorado Water Conservation Board) <br />hereinafter referred to as the State, and 'Z_ Terrace Irrigation Company, P.O. Box 667, <br />Mon ViG -ta- Colorado 81144 <br />hereinafter referred to as the contractor <br />WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made <br />available and a sufficient unencumbered balance thereof remains available for payment in Fund Number 4008 <br />G/L Account Number 531 axax , Contract Encumbrance Numbe and <br />WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate <br />agencies; and <br />WHEREAS, '3 pursuant to the provisions of 37 -60 -119, Colorado Revised Statutes <br />1973, as amended, the State is authorized to construct certain water projects for <br />the benefit of the people of the State; and <br />WHEREAS, the Contractor is an irrigation company in the State of Colorado <br />and wishes to undertake repairs of the Terrace Reservoir Project hereinafter <br />called the project, for the members of the Terrace Irri ation Company in Conejos <br />County, Colorado, at an estimated cost of about i d Twenty Thousand Six <br />Hundred Dollars ($620,600); and <br />WHEREAS, the State has agreed to construw part o r ject and to sell <br />the same to the Contractor upon mutually agreeab d� , ditions, subject <br />to the approval of appropriations for tha s orado General <br />A;; embly and the Governor of the State of o nd <br />WHEREAS, pursuant to Senate Bill No, 67, Fifty- Second General Assembly of <br />the State of Colorado, duly enacted by the Colorado General Assembly and approved <br />by the Governor of the State of Colorado, there was appropriated to the State the <br />sum of Six Hundred and Twenty Thousand Six Hundred Dollars ($620,600) for the <br />construction of parts of the project; and <br />WHEREAS, the Contractor has available from its own sources and from other <br />sources sufficient funds to construct the remainder of the project; <br />NOW THEREFORE, in consideration of the mutual and dependent covenants herein <br />contained, it is agreed by the parties as follows: <br />A. The Contractor agrees that it will -:w-° ,* <br />1. Cause the construction of said project to be completed within two (2) <br />years of the date of this contract in accordance with the project plans and <br />specifications and any necessary modification thereof approved by the State. No <br />payment will be made under this contract until the Contractor has submitted project <br />plans and specifications and said project plans and specifications are approved <br />by the State. The above mentioned time may be extended by the State if such time <br />io insufficient because of acts of God or other acts or circumstances beyond the <br />control of the Contractor. <br />2. Convpy or cause title to be conveyed by deed or other proper conveyance <br />to the State, the following portions of the proposed project facilities: <br />(a) A steel pipe, 5/16 inch thick, 48 inch diameter 269+ feet long, <br />inside the existing reservoir rock outlet tunnel. <br />(b) A 42 inch diameter ring jet throttling valve, connected to the <br />downstream end of the pipe described under (a). <br />(c) Appurtenances and controls necessary for the operation of the <br />system as described in (a) and (b). <br />(d) Two 48 inch diameter reservoir outlet gate valves (repaired), <br />located at the outlet works of the existing dam. <br />(e) A 12+ foot high 6000+ cu. yd, cofferdam to be constructed for <br />repair purposes within the reservoir basin.
