urm 6- AC -02A DE -MENT OR'AGENCY NUMBER -4-04-00 CONTRACT ROUTING NUMBER EXHIBIT A q0 20 CONTRACT $620,600 THIS CONTRACT, made this 15th day of September —1982., by and between the Slate of Colorado for the use and benefit of the Department of '� NATURAL RESOURCES (Colorado Water Conservation Board) hereinafter referred to as the State, and 'Z_ Terrace Irrigation Company, P.O. Box 667, Mon ViG -ta- Colorado 81144 hereinafter referred to as the contractor WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made available and a sufficient unencumbered balance thereof remains available for payment in Fund Number 4008 G/L Account Number 531 axax , Contract Encumbrance Numbe and WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate agencies; and WHEREAS, '3 pursuant to the provisions of 37 -60 -119, Colorado Revised Statutes 1973, as amended, the State is authorized to construct certain water projects for the benefit of the people of the State; and WHEREAS, the Contractor is an irrigation company in the State of Colorado and wishes to undertake repairs of the Terrace Reservoir Project hereinafter called the project, for the members of the Terrace Irri ation Company in Conejos County, Colorado, at an estimated cost of about i d Twenty Thousand Six Hundred Dollars ($620,600); and WHEREAS, the State has agreed to construw part o r ject and to sell the same to the Contractor upon mutually agreeab d� , ditions, subject to the approval of appropriations for tha s orado General A;; embly and the Governor of the State of o nd WHEREAS, pursuant to Senate Bill No, 67, Fifty- Second General Assembly of the State of Colorado, duly enacted by the Colorado General Assembly and approved by the Governor of the State of Colorado, there was appropriated to the State the sum of Six Hundred and Twenty Thousand Six Hundred Dollars ($620,600) for the construction of parts of the project; and WHEREAS, the Contractor has available from its own sources and from other sources sufficient funds to construct the remainder of the project; NOW THEREFORE, in consideration of the mutual and dependent covenants herein contained, it is agreed by the parties as follows: A. The Contractor agrees that it will -:w-° ,* 1. Cause the construction of said project to be completed within two (2) years of the date of this contract in accordance with the project plans and specifications and any necessary modification thereof approved by the State. No payment will be made under this contract until the Contractor has submitted project plans and specifications and said project plans and specifications are approved by the State. The above mentioned time may be extended by the State if such time io insufficient because of acts of God or other acts or circumstances beyond the control of the Contractor. 2. Convpy or cause title to be conveyed by deed or other proper conveyance to the State, the following portions of the proposed project facilities: (a) A steel pipe, 5/16 inch thick, 48 inch diameter 269+ feet long, inside the existing reservoir rock outlet tunnel. (b) A 42 inch diameter ring jet throttling valve, connected to the downstream end of the pipe described under (a). (c) Appurtenances and controls necessary for the operation of the system as described in (a) and (b). (d) Two 48 inch diameter reservoir outlet gate valves (repaired), located at the outlet works of the existing dam. (e) A 12+ foot high 6000+ cu. yd, cofferdam to be constructed for repair purposes within the reservoir basin. Items (a) and (b) are *(See instructions on reverse of last page.)
