3. Notice and Jurisdiction: All notices of this matter required by law have been <br />fulfilled and the Court has jurisdiction over the Application and all parties affected thereby, <br />whether or not they have chosen to appear. <br />4. Objectors: Ronald and Linda Hammons; Mountain Land & Cattle Company, LLC; <br />and George and Barbara Rupp, Robert Sheets, Patrick and Laurie Long, Linda and Curtis <br />Stone, Jane Proctor, Gary Marchand, Helen Marchand, Noah and Buddy Taylor, and Roger <br />and Chase Rupp filed timely Statements of Opposition and the time for filing additional <br />Statements of Opposition has passed. All parties filing Statements of Opposition have <br />either reached Stipulations with the CWCB, withdrawn their Statement of Opposition, or <br />otherwise do not object to the terms contained herein. <br />5. Consultation: The Division Engineer filed a Summary of Consultation pursuant to <br />§ 37- 92- 302(4) C.R.S. dated February 25, 2005. The CWCB has addressed the Division <br />Engineer's concerns set forth in the Summary of Consultation. <br />6. Name of Natural Stream: Currant Creek ( instream flow) <br />7. Location: <br />Legal description of the stream segment through which an instream flow is claimed: <br />a. The natural stream channel at the confluence of Mill Gulch at latitude 38° <br />39' 50 "Nand longitude 105° 29'41"W as the upstream terminus and <br />extending to the confluence of Cottonwood Creek at latitude 38° 31' <br />17 "N and longitude 105° 23' 59 "W as the downstream terminus, being a <br />distance of approximately 16 miles. This segment can be located on the <br />Cover Mountain and the Gribble Mountain U.S.G.S. quadrangles. <br />b. For administrative purposes only: <br />Upper Terminus = SE SE S12 TI 6S R73W 6PM <br />290' West of the East Section Line, 340' North of the South Section Line <br />UTM 4279602N 456962E <br />Lower Terminus = NE SW S36 T17S <br />R72W 6PM <br />1810' East of the West Section Line, 1920' North of the South Section <br />Line <br />UTM 4263742N 465156E <br />8. Use of the water: Instream flow to preserve the natural environment to a reasonable <br />degree. <br />9. The water was first applied to the above beneficial use on January 28, 2004. The <br />appropriation was completed on January 28, 2004 by the action of the Colorado Water <br />2 <br />
