IJune 30, 1997 <br />3. North Platte to J -2 Return <br />a. The parties agree that the activities described in this section <br />adequately respond to recommendations on the record of the FERC <br />proceeding that the Districts should restore, protect and manage four <br />habitat areas in this reach for sandhill cranes, terns, plovers, bald eagles, <br />waterfowl and other migratory birds. The parties agree that, except as <br />consistent with item 5, no other efforts to protect or create habitat in this <br />' reach of the river should be required of the Districts in their FERC <br />licenses. <br />b. The Districts will protect up to 4200 acres to be managed for <br />terns and plovers, sandhill cranes and other migratory waterfowl. The <br />' Districts' contribution will be capped at 4200 acres or total acquisition <br />costs of $6.3 million in 1997 dollars ($1500 /acre on average), whichever <br />is lower. <br />' d. The goal will be to acquire at least 1200 acres of the Habitat <br />Lands within 18 months of issuance of the FERC licenses, to increase <br />that total to at least 2200 acres within five years and to at least 3000 <br />' acres within nine years of issuance of the FERC licenses, and to acquire <br />the remainder of the 4200 acres within 13 years of license issuance, or <br />-5- <br />C. Parcels of land to be acquired shall be identified through <br />discussions with FWS and NGPC. The goals in identifying potential <br />' <br />lands for acquisition will be to acquire approximately two thirds of the <br />4200 acres in the reach between Gothenburg and Lexington and to <br />acquire land in blocks of approximately 1200 acres or more. In <br />recognition of the limited available opportunities, other Habitat Land and <br />alternative parcels may be in smaller blocks or at other locations in the <br />Platte or North Platte areas. All Habitat Lands will be acquired only <br />after discussion with FWS and NGPC, and concurrence by FWS. In the <br />event no Program is adopted, or the Program is terminated, the Districts <br />will, if requested by FWS after discussion with NGPC, (1) revise these <br />land acquisition goals to focus on the reach from below J -2 to Chapman, <br />and /or (2) sell some or all of their interests in Habitat Lands in the <br />' <br />upstream reaches and use the proceeds to fund acquisition, development <br />and maintenance of lands between J -2 and Chapman, provided that the <br />Districts shall first offer FWS (and if it declines, then NGPC and then <br />' <br />any foundation established under the Program to own land) a reasonable <br />opportunity to match any other offer received. <br />' d.
