IJune 30, 1997 <br />Governance Committee or its designee for dollars in excess of what is <br />ultimately determined to be Nebraska's share. <br />' B. Flows <br />' <br />1. Instream Flows to the Central Platte River. The parties agree that the <br />water management and flow regime of the Environmental Account Program is a <br />sufficient contribution by these Districts toward the flows recommended by <br />DOI, and should be adopted by FERC in lieu of the other recommended <br />instream flow regimes and operating rules on the record in the relicensing <br />' <br />proceedings. The parties agree that the Environmental Account Program is a <br />comprehensive water management plan; each provision supports every other <br />provision, and the water management plan may be viewed only as a complete <br />package. Dedication of water to wildlife purposes, operating rules and plan <br />administration (including planning, communications, coordination and <br />compliance) shall be as described in the Environmental Account Program. <br />2. North Platte state hatchery flows. NPPD will deliver North Platte state <br />hatchery flows up to 16 cfs consistent with NGPC's water rights. The parties <br />agree that these activities fulfill the agency recommendations on hatchery flows. <br />' <br />3. Bypass Flows. The parties agree that in lieu of the recommended bypass <br />flows at Keystone and at the Central Diversion Dam, following <br />the activities are <br />sufficient: <br />a. Keystone. NPPD will provide necessary flows to manage the <br />fishery in the rock weirs below the Keystone Diversion Dam consistent <br />with study results and with plans developed in discussions with NGPC. <br />b. Central Diversion Dam. Central should not be required to bypass <br />water past its Diversion Dam as there is already water from drains and <br />other returns a short distance below the Dam. <br />4. Limits on releases during sandhill crane staging. NGPC originally <br />recommended a limit on releases from Lake McConaughy during the spring <br />sandhill crane migration; the parties agree that no upper limit on releases from <br />Lake McConaughy should be established for these purposes during the sandhill <br />crane migration season. <br />5. "Spike" Flows. In coordination with FWS and NGPC, Central agrees to <br />develop and implement an operational plan for Central to use its best efforts to <br />- 11 - <br />
