• <br />3. establish technical committees composed of persons with appropriate <br />expertise, as appropriate, to carry out activities under the Cooperative <br />Agreement; <br />4. serve as arbiter of disputed external peer reviews upon request of any <br />technical committee; <br />5. agree on allocations of funds and other available resources to any <br />technical committees for utilization consistent with the committees' <br />responsibilities, subject to any applicable limitations on the use of federal or <br />state funds; <br />6. enter into an agreement with an appropriate entity for the administration <br />of certain funds expended pursuant to this Cooperative Agreement; <br />7. assess accomplishments, implement measures to correct any shortfalls, <br />and revise milestones accordingly; and <br />8. develop specific milestones for implementing a Program. <br />• Although the signatories agree to cooperatively ate in the Governance <br />Pe Y P artici P <br />Committee, nothing in this paragraph is intended to modify the provisions of Paragraph <br />X.E. <br />D. Contributions of the Signatories. The Department of the Interior and the States <br />of Nebraska, Colorado, and Wyoming will provide representatives to the Governance <br />Committee and to any technical committees established by the Governance Committee <br />without compensation from any other signatory. <br />E. Governance Structure for Any Program. The governance structure, <br />responsibilities and authorities described in Attachment III, Appendix C, shall be <br />applicable to any Program developed pursuant to this Cooperative Agreement unless, <br />after the NEPA evaluation, the signatories agree otherwise. <br />X. OTHER PROVISIONS <br />A. Geographic Scope. This Cooperative Agreement applies only to water related <br />activities and new water related activities occurring in the Platte River Basin upstream <br />of the confluence of the Loup River with the Platte River. <br />B. Term. This Cooperative Agreement shall remain in effect for three years or <br />• until the signatories enter into an agreement implementing a Program following the <br />11 <br />
