granted by Order dated April 1, 2008. All objectors have stipulated to the entry of this Decree. <br />The time for filing additional statements of opposition has expired. <br />4. S ' at'o . The CWCB stipulated to the entry of a proposed decree with the City of <br />Golden on July `, 2008. On July 2008, the City of Notthglenn and the City of Westminster <br />further entered into a stipulation with the City of Golden. The Objectors entering into said <br />stipulations have consented to entry of this Decree. The Court hereby approves of the foregoing <br />stipulations. <br />5. Summary of AAyolication. The Court granted absolute and conditional water rights to <br />the City of Golden in Case No. 98CW448, District Court, Water Division 1. The decree was <br />affirmed on appeal by operation of law. State Engineer v City of Golden, 69 P.3d 1027 (Colo. <br />2003). By the subject Application, the City of Golden seeks to make absolute a portion of the <br />water rights decreed in Case No. 98CW448, and a finding of reasonable diligence on all other <br />water rights decreed therein. The subject water right are described as follows: <br />A. Name of Structures: City of Golden White Water Course and City of Golden <br />White Water Course (Extension). <br />(1). City of Golden White Water Course ( "Course'l <br />i. Date of Original Decree: June 13, 2001, 98CW448, District Court, Water <br />Division 1. The decree was affirmed on appeal by operation of law. State Engineer v City of <br />Golden, 69 P.3d 1027 (Colo. 2003). <br />ii. LMW D _ascription. The Course is located within the modified channel of <br />Clear Creek in the NW l ?4 of the NEI A of Section 33, T. 3 S., R 70 W. of the 6th P.M., <br />Jefferson County, Colorado. The Course begins at a previously existing rock deflector device <br />followed by 7 dam structures of various types, each of which controls, concentrates and directs <br />the stream flow for the beneficial uses described below. The locations of the strictures that <br />constitute the Course are as follows: <br />a. Structure 1. A dam located at a point within the channel of Clear Cheek where the NW <br />comer of Section 33, T. 3 S., R. 70 W. bears N. 82 °569" W., a distance of approximately <br />2790 feet. <br />b. Structure 2. A deflector dam located at a point within the channel of Clear Credo where the <br />NW corner of Section 33, T. 3 S., R. 70 W. bears N. 84 °3737" W., a distance of approximately <br />2843 fat. <br />c. Structure 3. A deflector dam located at a point within the channel of Clear Creek where the <br />NW corner of Section 33, T. 3 S., R. 70 W. bears N. 85 °38133" W., a distance of approximately <br />2888 feet. <br />24627 2 <br />
