cfs in March between 6:00 p.m. and 6:00 a.m. (out of the 70 cfs decreed conditionally); 91 cfs in
October between 6:00 pm. and 6:00 a.m. (out of the 143 efs decreed conditionally); and 61 cis
in February between 6:00 a.m. and 6:00 p.m. (out of the 70 cfs decreed conditionally).
During 2005 there was one month when use was documented during periods when
strearnflow exceeded the volume decreed absolute in Case No. 98CW448, but flows were less
than the decreed conditional amounts. Specifically, there was documented use when the flow
was at 260 cfs in August between 6:00 p.m. and 6:00 a.m. and between 6:00 a.m. and 6:00 p.m.
(out of the 559 efs decreed conditionally).

During 2006 there was one month when use was documented during periods when
streamflow exceeded the volume decreed absolute in Case No. 98CW448, but flows were less
than the decreed conditional amounts. Specifically, there was documented use when the flow
was at 544 cfs in July between 6:00 p.m. and 6:00 am. (out of the 1000 cfs decreed
conditionally).

Dan Hartman has dated photographs and additional documentation of white water course
use from 2007 and 2008 that will supplement this memorandum. By way of example, on April
29, 2008, there were 100 kayakers using the course before 6:00 p.m., and 200 kayakers after 6:00
p.m. As the USGS is currently calibrating its gage on Clear Creek, we will be able to confirm
the exact flow when that calibration is complete.
Based on the foregoing chart of use data through 2006 and the April 2008 data, Golden is
