Toad, or other "non- target" listed species, then impacts to those species must be addressed in that <br />federal project's BO required by ESA. <br />For the purposes of this section the following definitions apply: <br />Covered means in compliance with the Endangered Species Act with regard to potential impacts <br />to the least tern, piping plover, whooping crane and pallid sturgeon in and along the central and <br />lower Platte River in Nebraska, for the duration of the First Increment. <br />Cumulative means total changes or total new activities, based on average project operations <br />relative to conditions existing at the time the Platte River Cooperative Agreement was signed <br />(July 1, 1997). <br />New means having come into existence or put into practice subsequent to the signing of the <br />Cooperative Agreement on July 1, 1997. <br />Average means the average estimated or modeled effect over a multi - decadal period of time <br />including a mix of wet, normal and dry hydrologic conditions. Initially, this will be the 1947- <br />1994 period used in the current version of the Central Platte OpStudy Model and the Platte <br />Programmatic EIS. However, this time period may adjusted if the Governance Committee <br />concurs. <br />Program means the Platte River Recovery Implementation Program, as agreed to by the <br />signatories from Colorado, Wyoming, Nebraska, and the Department of Interior. <br />Major On- Stream Reservoir means a reservoir of more than 2,000 acre -feet. It does not include <br />new diversion facilities that may impound a small amount of water. <br />II. NORTH PLATTE RIVER BASIN <br />A. Background Information <br />This document sets forth Colorado's Plan to address new water related activities in the North <br />Platte River Basin, Jackson County, Colorado. Subject to ongoing NEPA and ESA reviews, and <br />verification of certain assumptions, the parties to the Program Cooperative Agreement have <br />agreed that Colorado's Depletion Plan is a sufficient contribution to offset alleged effects on <br />endangered species habitats in Nebraska of new water related activities in the North and South <br />Platte River Basin in Colorado. Colorado's Depletion Plan for the South Platte is also <br />summarized in this subsection of the Program Water Plan. <br />Colorado proposes to include new water related activities in the North Platte River Basin in the <br />Platte River Recovery Implementation Program (Program) and to offset alleged effects on <br />endangered species habitats in Nebraska in accordance with this agreement.
