FEDERAL WATER RIGHTS AND BY -PASS FLOWS <br />Work to date: The U.S. Forest Service has historically sought instream flows for a number of <br />purposes on Forest Service lands. The Forest Service most recently sought to require certain by- <br />pass flows on Forest Service lands for the protection of fishery values downstream. The 1996 <br />Farm Bill included a provision setting up a moratorium for 18 months on the Forest Service's <br />imposition of such requirements and establishing a task force to study the issue of by -pass flows <br />for National Forest lands. The Federal Water Rights Task Force was also charged with making <br />recommendations for protecting the forest environment in general, instream flows and state water <br />rights. A WSWC member, Sherl Chapman of Idaho, was appointed to serve on the Task Force. <br />The Task Force released its recommendations in mid -1997 containing both majority and minority <br />positions. <br />1998: The Committee will observe and evaluate what impact the Task Force report may have <br />and any related developments. If deemed appropriate, the Committee will prepare a position <br />paper for Council consideration on the issues addressed by the Task Force. <br />Estimated work days: Reporting - 1 <br />Position Paper - 12 <br />Time frame: <br />4 AD HOC GROUP ON RESERVED INDIAN WATER RIGHTS <br />Work to date: The Ad Hoc Group was formed in response to an initiative undertaken first by <br />the Western Regional Council (WRC), a group of large business interests in the West. <br />Recognizing the potential dislocation of existing non -Indian uses that Indian water rights could <br />affect, they developed proposed legislation to quantify Indian water rights. They then took this <br />bill to Morris Udall of Arizona for consideration. He told them if they expected any success in <br />this endeavor, they would need to talk with the Tribes.
