Land Entity White Paper <br />November 30, 1999 <br />Under this option, Nebraska would be disproportionately represented, but other <br />than financing, the impacts of the land component fall on Nebraskans alone. Adding a <br />seat on the Governance Committee may be particularly appealing if it retains a strong <br />role in land program decision - making. <br />Z. Representation in the LOC or Board of a Strong Land Entity <br />If organizational options 1 or 3 are selected above, representation will need to be <br />worked out for a body with significant decision - making powers -- either the board of <br />directors of a strong Land Entity or the membership of the LOC. There are a number of <br />options available for consideration. They include, but are not limited to: <br />Governance committee membership plus one or more landowner representatives, <br />with decisions made by a super - majority which must include all four governments <br />to reach an affirmative decision. The super - majority could be constructed so that <br />the landowner representatives have a veto over "policy" decisions (or not). <br />Signatories plus one environmental group plus two local landowners plus a <br />representative of entities dedicating lands to the Program that will coordinate <br />through the LOC or Land Entity (perhaps for now, NPPD, as owner of <br />Cottonwood Ranch). A voting structure could be selected so that "policy" <br />decisions are made by agreement of all four governments, one landowner and one <br />other committee member. <br />• Signatories plus five landowner representatives. A simple majority could be used <br />to reach any decision. <br />3. Representation in a Land Entity Board for a Land Entity with <br />Limited Functions <br />If much of the decision - making authority is reserved to the Governance <br />Committee or to a Land Oversight Committee, the options above are available to govern <br />a Land Entity with limited responsibilities, but governance of the Land Entity may also <br />reasonably be drawn from a narrower group, such as: <br />Majority landowner representatives. <br />All or nearly all Nebraska representatives <br />States, environmental representative, landowner representatives, no federal <br />representatives to avoid conflict/waiver paperwork. <br />oxi <br />
