<br />THIS CONTRACT, made this 27th day of July 1981, by and between the
<br />State of Colorado for the use and benefit of the Department of '' Natural Resources
<br />(Colorado Water Conservation Board),
<br />hereinafter referred to as the State, and '2 Henrylyn Irrigation District,
<br />P. 0. Box 85, Hudson, CO 80647,
<br />hereinafter referred to as the contractor,
<br />WHEREAS, authority exists in the Law and Funds have been builpted, appropriated and otherwise made
<br />available and a sufficient unencumbered balance thereof remains ava' bk for meat in Fund Number 4 n n A
<br />G/L Account Number-5606X Encumbrance Numbe and
<br />WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate
<br />agencies; and
<br />WHEREAS, *3 the Governor of the State of Colorado declared
<br />that an emergency disaster existed in the State of Colorado
<br />under Proclamation of May 299 1981, which state of disaster was
<br />renewed on June 26, 1981; and
<br />WHEREAS, by Executive Order dated May 29, 1981, and
<br />renewed on June 26, 1981, the Governor suspended the
<br />operation of regulatory statutes, rules, regulations, and
<br />orders relating to the implementation of procedures developed
<br />by the Division of Disaster Emergency Services for disbursing
<br />monies for repairs to Horse Creek D Horse Creek located in
<br />Adams and Weld Counties and In r, CRS 1973, 37 -60 -121,
<br />122, and 123, as amended, wh to a Colorado Water
<br />Conservation Board Construct) , S 1973, 24 -30 -202,
<br />as amended, together with all les ns, and orders
<br />promulgated thereunder which re � al procedures for
<br />execution of contracts by t t a d
<br />WHEREAS, irrigation systWs in Larimer, Weld, Logan,
<br />Morgan, Sedgwick, and Washington Counties are in immediate need
<br />of repair; and
<br />WHEREAS, pursuant to the Disaster Emergency Proclamations
<br />and Directives of the Division of Disaster Emergency Services
<br />Issued thereunder, the office of the Director of the Colorado
<br />Water Conservation Board is to repair Horse Creek Dam on Horse
<br />Creek, located within the State disaster declared counties
<br />requiring emergency action to restore essential services
<br />provided by these quasi public carriers as rapidly as possible;
<br />and
<br />WHEREAS, it is agreed that funds are available in the
<br />Colorado Water Conservation Board Construction Fund for the
<br />repair of Horse Creek Dam; and
<br />WHEREAS, the guidelines for assistance In the conservation
<br />and utilization of Colorado's water resources through the
<br />Colorado Water Conservation Board Construction Fund will be
<br />used to process applicati-ons from ditch company applicants; and
<br />WHEREAS, the Contractor is a duly constituted and
<br />organized irrigation district in the State of Colorado and
<br />aareAs to undertake the repair, replacement, or reconstruction
<br />of the Horse Creek Dam in S32, TIN, R64W, Weld County,
<br />Colorado, a principal component of the irrigation system owned
