3. Require all Sub - contractors to indemnify the State and <br />the Contractor against all liability and loss, and against all <br />Claims and actions based upon or arising out of damage or <br />Injury, Including death, to persons or property caused by or <br />sustained in connection with the performance of any sub- <br />contract or by conditions created thereby, or based upon any <br />violation of any statute, ordinance, or regulation, and the <br />defense of any such claims or actions. <br />4. Require all Sub - contractors to maintain liability <br />insurance In at least the following amounts: <br />a. For any injury to one person in any single <br />occurrence, the sum of One Hundred Fifty Thousand <br />Dollars ($150,000). <br />b. For any injury to two or more persons in any <br />single occurrence, the sum of Four Hundred Thousand <br />Dollars ($400,000). <br />Said liability insurance shall name the Contractor <br />and the State as co- insureds. No payments shall be made under <br />this contract unless a copy of a certificate of said liability <br />Insurance has been filed with the Colorado Water Conservation <br />Board. <br />5. Convey or cause title to be conveyed by deed or <br />other proper conveyance to the Colorado Water Conservation <br />Board, Department of Natural Resources., State of Colorado, the <br />following portions of the proposed project facilities within <br />thirty (30) days of their completion: <br />Filter improvements, as shown 1 s 3 and 4 <br />(Appendices A and B) and des d tail as <br />follows: <br />a. Rebuilding of backwash trou w 1, consisting of <br />one wall plug, approximately 8' 1x18" at each <br />'Present backwash trough open, a total of nine <br />wall plugs. <br />b. New Filter overflow modifications. <br />C. New backwash troughs, replacing the three <br />existing backwash collection troughs in each filter <br />with four new troughs. A total of twelve troughs <br />will be built. <br />d. Two 400 -gpm pumps. <br />e. Two 600 -gpm pumps. <br />f. Four surface wash agitators, to be added to each <br />Filter, for a total of twelve. <br />g. A 166 -foot 20 -inch steel pipe and fittings. <br />h. Ten 20 -inch htitterfl.v valves. <br />1. A 5900 -gpm 20 -Inch Inline mixer. <br />J. A 5900 -gpm 20 -inch flow tube. <br />k. A 750 - pound /day unit line feeder. <br />1. A 1,500 -pound /day alum feeder unit. <br />M.
