<br />THIS CONTRACT, made this 1st day of _September 198b, by and between the
<br />State of Colorado for the use and benefit of the Department of '1 Natural Resources

<br />P.O. Box 5220, Steamboat Springs. Colorado 80499
<br />hereinafter referred to as the contractor,
<br />WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made
<br />available and a sufficient unencumbered balance thereof remains a ilab�ayment in Fund Number An OR ,

<br />WHEREAS, required appfoval, clearance and coordination has been accomplished from and with appropriate
<br />agencies; and
<br />WHEREAS,'3 the State and the Contractor did, on July 1, 1979, enter into
<br />a contract for State participation in the construction of the Yamcolo project
<br />for the members of the Upper Yampa Water Conservancy District in Garfield
<br />County, Colorado at an estimated cost of One Million Dollars ($1,000,000),
<br />which contract is attached hereto as exh "A" gnd%bereby incorporated into

<br />WHEREAS, the State and the Contrac

<br />NOW THEREFORE, in consideration of
<br />contained, it is agreed by the partie

<br />1. The terms and provisions of that certain contract dated July 1, 1979,
<br />attached hereto as exhibit "A" and incorporated herein by reference, remain
<br />in full force and effect except as amended herein.
<br />2. Paragraph A.2 is hereby amended to read as follows:
<br />2. Convey or cause title to be conveyed by deed or other proper conveyance
<br />to the Colorado Water Conservation Board, Department of Natural Resources,
<br />State of Colorado, the following portions of the proposed project facilities:
<br />An undivided Thirty -One Hundred Twenty- Firsts (30/121) interest in
<br />and to the Yamcolo Reservoir together with all inlet and outlet
<br />ditches and structures.appurtenant thereto or used in connection
<br />therewith.
<br />3. Paragraph A.9 is hereby amended to read as follows:
<br />9. To purchase from the State all of the State's right, title, and interest
<br />in said project and any facilities thereof at a total purchase price of
<br />Two Million Eight Hundred Ninety -Six Thousand Dollars ($2,896,000)payable
<br />S in forty (40) annual installments of Seventy -Two Thousand Four Hundred
<br />Dollars ($72,400) each, which first installment shall be due and payable
<br />mvlo& -r on ember--11 1981, and yearly thereafter until the entire principal
<br />sum shall have been paid. Said installment payment shall be made payable
<br />\ to the Colorado Water Conservation Board, payable at the said Board offices
<br />in Denver, Colorado.

<br />4. Paragraph B.1 is hereby amended to read as follows:
<br />1. Make available to the Contractor for the purpose of this contract the
<br />sum of One Million Four Hundred Seventy -Nine Thousand Seven Hundred Twenty -
<br />Five Dollars ($1,479,725),. Said One Million Four Hundred Seventy -Nine
<br />Thousand Seven Hundred Twenty -Five Dollars ($1,479,725) shall be made
<br />available to the Contractor in accordance with the following terms, schedule
<br />and conditions.
