a. This agreement shall take effect upon the latest date shown in the signature blocks 15 through <br />19 on the Assistance Agreement Form 7 -2277. <br />b. This agreement shall remain in effect through September 30, 2000, unless the agreement is <br />extended, modified or terminated after execution. <br />B.6. AMOUNT OF THE AGREEMENT <br />a. For providing services pursuant to this agreement, the Foundation shall be reimbursed for its <br />expenses as follows: charge Reclamation and the States a sliding scale percentage rate which in <br />turn is based upon the combined fund balances of Reclamation and the States at the time of <br />disbursement. These fees are to cover financial management and personnel /contracts <br />management services: <br />Combined <br />Fund Balance <br />Percentage Charize <br />$0 to $4,999 <br />No Fee/No Earnings <br />$5,000 to $49,999 <br />3.5% <br />$50,000 to.$99,999 <br />3.0% <br />$100,000 to $249,999 <br />2.5% <br />$250,000 to $499,999 <br />2.0% <br />-$500,000 and above <br />1.0% <br />Note: For example, if a $5,000 disbursement was requested when the combined fund balances were <br />$100,000, a fee of $125 would be assessed. <br />b. Unless otherwise directed by the Governance Committee, the fees shall be shared by the <br />Parties based on the percentages cited in B.2.g., above. <br />c. This agreement creates no obligation of the States or Reclamation for contribution of funds <br />beyond that specified in the July 1997 Agreement and as may be made available by <br />appropriation. Funding for the Foundation activities will be provided from funds to be <br />contributed by the States and Federal Government in accordance with the July 1997 Agreement. <br />d. The Foundation's cost of providing its services may only be increased by decision of the <br />Governance Committee and concurrence by Reclamation and the States. The Foundation shall <br />provide a 60 -day advance written notice to the Executive Director, Grants and Cooperative <br />Agreements Officer, and the States if it anticipates that the budgeted amount for a given period <br />will be insufficient. All costs incurred by the Foundation beyond the budget amount for the <br />periods specified above prior to the required approval shall be borne by and become the sole <br />responsibility of the Foundation. <br />e. The Parties are committed to a mutual cooperative effort to share anticipated budget and <br />expenditure trends with the Foundation in the interests of maintaining . a smooth working <br />relationship on a day -to -day basis. <br />• SECTION C.
