The delay in moving this modification forward was a result of receiving a modification that was not <br />formatted in a manner that is routinely used by Colorado. I approached the other parties with a proposa <br />that would have formatted the modification in a manner more routine for Colorado. The other parties, <br />especially the federal government, were concerned about using a "routine Colorado format" because they <br />and the other states (Wyoming and Nebraska) have not used Colorado's format. As a compromise, based <br />on discussions between Mr. Goodnough and Mr. Holtman, Colorado has agreed that we can use the <br />federal modification form with the condition that the appropriate signature lines be added and the relevant <br />signatures obtained. - Unfortunately, the resolution of this issue extended beyond the original performance <br />period. I apologize for this delay. <br />In the process of negotiating and evaluating the processes needed to extend the period of performance I <br />identified that two previous modifications to the Agreement had been processed: The first modification <br />was to clarify the Federal Governments funding commitment. The second modification was <br />administrative in nature an involved giving more definitive direction on the timing for calculating and <br />accessing administrative fees. Since Modification 001 only involved a clarification on funding for the <br />federal government I have been told that Colorado does not need to take any action on this. Modification <br />002 is attached and will be routed with a distinct CLIN number. Modification 003 will be routed with a <br />distinct CLIN number. Finally, I would like to explain that I think that the two previous modifications <br />(001 and 002) were not routed for full signatures because previous staff believed that they had signature <br />authority. I believe this issue has been resolved. <br />I have attached the original Agreement and Modifications 002 and 003 (Exhibit A) with the additional <br />required signature blocks. I would like to also let you know that I anticipate a future modification to the <br />scope and budget of the Agreement within the next 6 months. It will be my goal to obtain greater clarity • <br />and understanding on the administration of the Agreement during this process. <br />Thank you for your assistance on this difficult issue.
