Headwaters Corporation <br />Providing Services as Office of the Executive Director for <br />Platte River Recovery Implementation Program <br />Summary of Significant Activity for the Period <br />August 26 to September 22, 2012 <br />Land Plan Implementation <br />• Focus of land management efforts were on completion of draft work plans for 2013 for all complexes. These <br />plans serve as the basis for 2013 budget development. Extensive coordination and review by LAC to follow. <br />• Focus of real estate acquisitions for this period were on concluding negotiations for one complex property at <br />Fort Kearny Complex and one non - complex palustrine wetland in Phelps County <br />• Routine and on -going discussion with neighboring land- owners in conformance with Good Neighbor Policy <br />for all properties. <br />• Continuing discussions with property owners and real estate agents that will lead to identification of new <br />potential properties. The focus is on properties with non - complex, palustrine wetland and sand pit potential. <br />Several opportunities are being explored for sand pit and palustrine wetland properties. <br />• Bids solicited for Fox Tract (in Fort Kearney Complex) conversion to wet meadow. <br />• Coordination on -going with Ducks Unlimited for repair of head cutting and replacement of check structures <br />that occurred on John's Tract in the Elm Creek Complex from high flows in summer 2011. Corps of <br />Engineers permits for the head cutting portion of the work received in late September, allowing work to <br />proceed. <br />• Routine management, oversight, and maintenance operations on all properties and equipment, including <br />fence repair, well maintenance, road maintenance, and building upkeep. <br />• Routine seasonal land management activities involving contractor selection, coordination, and oversight on <br />several properties including noxious weed control, grass seeding, in- channel vegetation control, and similar <br />actions. <br />• Coordination with tenants for on -going agricultural operations. Development of leases for 2013 underway <br />with several tenants. Addition of explicit terms to leases concerning actions impacted by Migratory Bird <br />Treaty Act is a focus of the effort. <br />Water Plan Implementation <br />• Work continuing on development of J2 Reregulating Reservoir Water Service Agreement. Efforts focused <br />on resolution of water rights and O, M &R fees. <br />• J2 Reregulating Feasibility Study progressing, oversight of consultant on- going. <br />• On -going discussions toward resolution of issue with DNR of quantifying and satisfying augmentation <br />requirement for Off - Channel Sand and Water projects. <br />• Continued coordination efforts with consultants, NRDs, DNR, and CNPPID associated with ground water <br />recharge pilot demonstration project, year 2. Monitoring efforts on -going and expanded monitoring plan <br />finalized. Water Service Agreement with CNPPID for recharge of excess to target flows in place and <br />permitting for use of EA water under way. <br />• On -going discussions with surface water right holders interested in selling water yields to Program. <br />Discussions between NPPD, CNPPID, DNR, and CPNRD with the Program concerning such water transfers <br />occurring. Key period of analysis and basic sustainability issues largely resolved and intense analysis efforts <br />underway. In particular, the most intense effort is focused on calculation of yield quantity and timing <br />associated with GW recharge, and net effect on river of relinquished surface water lands now irrigated by <br />groundwater. <br />1 <br />
