Unit 77 -77 -777, <br />WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate <br />agencies; and <br />WHEREAS, pursuant to the provisions of section 37 -60 -119, <br />Colorado Revised Statutes, as amended, the State is authorized <br />to construct certain water projects for the benefit of the <br />people of the State of Colorado; and <br />WHEREAS, the City of Greeley has made application to the <br />State for the improvement of its existing facility, the Barnes <br />Meadow Reservoir Dam, such improvement of the facility is <br />hereinafter sometimes referred to as the project; and <br />WHEREAS, the Contractor is a city within the State of <br />Colorado; <br />NOW THEREFORE, it is hereby agreed that: <br />1. The Contractor shall hP easibility report prepared <br />and directed to the problem o in t e facilities of the <br />Barnes Meadow Reservoir Da c th a proposal for a <br />project feasibility report a consulting <br />engineering firm of Morrison nu ineers, Inc. (the <br />Consultant), and approved by t e. received May 28. 1987, <br />which proposal is attached s Exhibit A and made a part <br />of this contract. <br />2. Fifteen (15) copies of the final report called for in <br />this contract shall be furnished to the State not later than <br />October 31, 1987, unless such time is extended by mutual <br />agreement of the parties hereto in writing. <br />3. As compensation for the services of the Contractor, the <br />State shall pay to the Contractor the sum of Twenty -Two <br />Thousand Six Hundred Eighty -Three Dollars ($22,683) in the <br />manner following: <br />a. Sixty percent (60 %), to wit, Thirteen Thousand Six <br />Hundred Nine Dollars and Eighty Cents ($13,609.80) of the <br />total amount due in two (2) monthly installments of Six <br />Thousand Eight Hundred Four Dollars and Ninety Cents <br />($6,804.90) each, commencing on August 14, 1987. <br />b. The remaining forty percent (40'x), to wit, Nine <br />Thousand Seventy -Three Dollars and Twenty Cents ($9,073.20) <br />within forty (40) days following receipt and acceptance of <br />the written report specified in paragraph 2. of this <br />contract. <br />4.
