<br />THIS DEED OF TRUST, dated b4ckp_ 2cf 1992-, between THE CITY OF GREELEY.
<br />COLORADO, a Municipal Corporation Organized And Existing Under And By Virtue Of
<br />The Laws Of The State Of Colorado, the grantor herein, whose address is 1000
<br />Tenth Street, Greeley County of Weld and the State of Colorado, and the PUBLIC
<br />TRUSTEE of the State in which the property described below is situated, in the
<br />State of Colorado,
<br />Witness:
<br />The grantor, to secure a promissory note or notes, hereinafter referred to in the
<br />singular, for the total principal sum of Three Hundred Thirteen Thousand, Four
<br />Hundred Twenty -Four Dollars ($313,424), payable to the order of COLORADO WATER
<br />CONSERVATION BOARD, A State Board or Department of Natural Resources Of the State
<br />Of Colorado, 721 State Centennial Building, 1313 Sherman Street, Denver, Colorado
<br />80203, with interest thereon from the date thereof at the rate of FIVE (5)
<br />percent per annum, principal and interest payable In Constant Annual Installments
<br />of Twenty -Five Thousand One Hundred Fifty Dollars And Forty -Four Cents
<br />($25,150.44) Each For Twenty (20) Years Beginning The First Day Of The Month Next
<br />Succeeding The Month In Which The State Determines The Project Substantially
<br />Completed does hereby grant and convey unto said Public Trustee the following
<br />described property, situate in the County of Larimer, State of Colorado, to wit:
<br />All that certain storage reservoir known as The Barnes Meadow Reservoir
<br />located on portions of the South Half of the Southeast Quarter (S 1/2 SE 1/4),
<br />the East Half of the Southwest Quarter (E 1/2 SW 1/4), and the Southwest Quarter
<br />of the Southwest Quarter (SW 1/4 SW 1/4) of Section 5, and the Southwest Quarter
<br />of the Southwest Quarter (SW 1/4 SW 1/4) of Section 4, and the Northwest Quarter
<br />of the Northwest Quarter (NW 1/4 NW 1/4) of Section 9, and the North Half of the
<br />Northeast Quarter (N 1/2 NE 1/4), and the Northeast Quarter of the Northwest
<br />Quarter (NE 1/4 NW 1/4) of Section 8, Township 7 North, Range 75 West, of the
<br />Sixth P.M., together with all dams, embankments, inlet ditches, outlet gates, and
<br />outlet ditches, and all improvements, constructions, and appurtenances connected
<br />therewith, (excepting buildings and cabins located outside of the high water
<br />contour line or below the outside toe of the dam of said Reservoir), expressly
<br />including the Trap Creek inlet ditch and the Cache La Poudre inlet ditch as
<br />described in that certain amended filing map and statement of said Reservoir,
<br />hereinafter described, and all water rights and appropriations now or hereafter
<br />effected or initiated by the construction or use of said Reservoir and said
<br />ditches and all enlargements or extensions thereof, together with all maps,
<br />plats, statements, and filings made therefor, including reservoir priority No.
<br />126 adjudicated to said Reservoir by the District Court in and for Larimer
<br />County, Colorado, as of June 22, 1921, for a storage depth of thirty (30) feet
<br />and an estimated capacity of 73,930,600 cubic feet and conditional reservoir
<br />priority No. 1290 adjudicated to said Reservoir by said District Court as of May
<br />30, 1922 for an additional storage depth of seventeen (17) feet and an additional
<br />estimated storage capacity of 76,081,811 cubic feet, conditional upon diligent
<br />completion of the enlargement of said Reservoir.
<br />ALSO all that portion of the South Half of the Southeast Quarter (S 1/2 SE
<br />1/4) and the East Half of the Southwest Quarter (E 1/2 SW 1/4) of Section 5,
<br />Township 7 North, Range 75 West, of the Sixth P.M., included within the high
<br />water contour line of said Reservoir, as described in the enlargement and amended
