CONTRACT AMENDMENT #1
THIS AMENDMENT, made this day of 1995, by and between the State of Colorado
for the use and benefit of the Departme t of Natural Resources, Colorado Water Conservation Board (CWCB),
hereinafter referred to as the STATE, and the CITY OF GREELEY, Greeley Civic Center, Greeley, Colorado 80631,
hereinafter referred to as the CONTRACTOR.
RECITALS
1. Authority exists in the law, and funds have been budgeted, appropriated, and otherwise made available and
a sufficient unencumbered balance thereof remains available for payment in Fund Number 424, Appropriation Code
362, Contract Encumbrance Number C153633; and
2. Required approval, clearance, and coordination has been accomplished from and with appropriate agencies;
and
3. The STATE and the CONTRACTOR entered into a contract dated November 19, 1992, Contract Routing Number
93314, Contract Encumbrance Number C153633, hereinafter referred to as ORIGINAL CONTRACT, wherein the STATE
agreed to loan money in the total amount of $250,000 ($230,000 for project construction and $20,000 for feasibility
report contract) to the CONTRACTOR to be used for enlargement and rehabilitation of Hourglass Dam and the CONTRACTOR
agreed to repay the loan in accordance with the terms of the ORIGINAL CONTRACT; and
4. Paragraph A.2 of the ORIGINAL CONTRACT states that the completion date of the PROJECT is to be within two
and one -half (2 1 /2) years from the date of the ORIGINAL CONTRACT unless extended by the STATE due to circumstances
beyond the control of the CONTRACTOR; and
5. CONTRACTOR has supplied a letter dated March 71 199 eto as ATTACHMENT A and made a
0. part hereof, requesting an extension for the date of completion, e d and reason for the extension;
and
6. The STATE has reviewed the situation and is satisfie th S TOR'S need for an extension of one
and one -half (1 1/2) years is reasonable and necessary; and
7. The STATE and the CONTRACTOR agree to extend the time for completion of the ORIGINAL CONTRACT by one
and one -half (1 1/2) years to November 19, 1996.
NOW THEREFORE, it is hereby agreed that
1. Consideration for this Amendment to the ORIGINAL CONTRACT consists of the payments which shall be made
pursuant to this Amendment and ORIGINAL CONTRACT and the promises and agreements herein set forth.
2. It is expressly agreed by the parties that this Amendment is supplemental to the ORIGINAL CONTRACT which
is made a part hereof, and identified as ATTACHMENT B and all terms, conditions, and provisions thereof, unless
specifically modified herein, are to apply to this Amendment as though they were expressly rewritten, incorporated,
and included herein.
3. It is agreed the ORIGINAL CONTRACT is and shall be modified, altered, and changed to read as follows:
a. Paragraph B.2: Contract for the construction of said PROJECT to responsible and capable firms, hereinafter
referred to as CONSTRUCTION FIRMS, which CONSTRUCTION FIRMS shall be selected through competitive public
bidding, said PROJECT to be completed within four (4) years of the date of this contract (by November 19,
