O. Box 1120, Glenwood SDrinas. Colorado 81602. <br />hereinafter referred to as the contractor /Contractor or Borrower. <br />WHEREAS, authority eidsts in the Law and Funds have been budgeted, appropriated and otherwise made available and a sufficient <br />unencumbered balance thereof remains available for payment in Fund Number 424 Organization YYYY . Appropriation 3368 Program <br />WTRC . Object Code 5120, Contract Encumbrance Number, &J ;and <br />WHEREAS, required approval, clearance, and coordination have <br />been accomplished from and with appropriate agencies; and <br />WHEREAS, the State is authorized to loan money for the <br />construction of water projects for the benefit of the people of <br />the State pursuant to the provisions of Section 37 -60 -119, <br />Colorado Revised Statutes; and <br />WHEREAS, the State is authorized to take a security <br />interest in property or take such bonds, notes, or other <br />securities evidencing an obligation as will assure repayment of <br />funds made available pursuant to Section 37 -60 -120, C.R.S.; and <br />WHEREAS, the Contractor is a nstituted water <br />conservation district under Sec 6 -1 , C.R.S., et seq., <br />in the State of Colorado and o c fit, or cause to be <br />constructed, the Ritschard Dam Wo o ntain Reservoir <br />and associated site development e a er called the <br />project, at an estimated cost r�.'''ree Million Dollars <br />($43,000,000); and <br />WHEREAS, a feasibility investigation of said project was <br />conducted by Morrison - Knudsen Engineers, Inc., and it was found <br />that the project is technically and financially feasible; and <br />WHEREAS, the final Environmental Impact Statement was <br />completed by the U.S. Department of the Interior, Bureau of Land <br />Management, in February, 1990, for the project, and the project <br />has been found to have no significant unmitigated environmental <br />impacts; and <br />Page 1 of 10 Pages <br />
