all rights created by the Mortgage /Deed of Trust to the undersigned <br />corporation on the property above-described and the improvements <br />and water rights appurtenant thereto to the lien of the Deed of <br />Trust to be given to the State of Colorado, Department of Natural <br />Resources (Colorado Water Conservation Board) . The lien to be <br />granted for the benefit of the State of Colorado shall constitute <br />a first and prior lien on the property described herein to the same <br />extent as though it were actually executed and recorded prior to <br />the Mortgage /Deed of Trust of the Farm Credit Bank. <br />10. Wamsley shall promptly apply for approval of the Bank- <br />ruptcy Court and give notice and furnish a copy of this Agreement <br />to the Trustee in Bankruptcy, Farm Credit Bank will cooperate with <br />Wamsleys in ..getting approval of this-Agreement. This Agreement, <br />when approved by the Bankruptcy Court, shall be recorded. <br />11. There are no other agreements between the parties except <br />as set forth in this Agreement. The other requirements of the Farm <br />Credit Bank in connection with the Wamsleys seeking approval of the <br />Bankruptcy Court and updating the status of the reorganization <br />agreement shall be in a separate written agreement between Wamsley <br />and Farm Credit Bank which addresses those matters. <br />12.
