petition, the number of signatures thereon, that all the signatures were affixed in the <br />Circulator's presence, that the Circulator believes them to be the genuine signatures of the <br />persons whose names they purport to be and that each signer read the full text of the <br />ordinance proposed or sought to be reconsidered prior to signing the petition. <br />(E) Time for Filing Referendum Petitions. A referendum petition complying with <br />the requirements of this Article must be filed within thirty days after adoption by the <br />Council of the ordinance sought to be reconsidered or it shall be of no effect. <br />6 -4: Review of Petition. Within five working days after the petition is filed, the Town Clerk <br />shall issue a decision as to its sufficiency, specifying, if it is insufficient, the particulars <br />wherein it is defective and shall promptly send a copy of the decision by U.S. mail to the <br />petitioners' committee and return the petition. A petition with an inadequate number of <br />signatures may be refiled once with additional signatures but must be filed within the <br />time limit of Section 6 -3(E). <br />6 -5: Suspension of Ordinance. When a referendum petition is filed with the Town Clerk, the <br />ordinance sought to be reconsidered shall be suspended from taking effect. Such <br />suspension shall terminate upon the occurrence of any of the following events: <br />(1) a determination of insufficiency of the petition; <br />(2) withdrawal of the petition by the petitioners' committee; <br />(3) repeal of the ordinance by the Council; or <br />(4) upon certification of a favorable vote on the ordinance. <br />6 -6: Council Action on Petitions. When an initiative or referendum petition has been finally <br />determined sufficient, the Council shall promptly consider the adoption of the initiated or <br />repeal of the reconsidered ordinance. If the Council fails to adopt a proposed initiative <br />ordinance without any change in substance within 60 days or fails to repeal the referred <br />ordinance within 60 days after the date the petition was determined sufficient, it shall <br />submit the proposed or referred ordinance to the voters of the Town at a regular or <br />special election within 120 days, or as otherwise required by the Colorado Constitution. <br />6 -7: Amendment and Repeal. An ordinance adopted by the electorate may not be amended or <br />repealed by the Town Council for a period of six months after the date of the election at <br />which it was adopted, and an ordinance repealed by the electorate may not be <br />reenacted by the Town Council for a period of six months after the date of the election at <br />which it was repealed, but such ordinances may be adopted, amended or repealed at any <br />time by the voters. <br />6 -8: Additional Procedures. The Town Council may by ordinance prescribe additional <br />procedures as necessary or appropriate for the initiative or referendum process. <br />The Charter of the Town of Ridgway 15 <br />
