Voluntary Flow Management Programs: Voluntary flow management programs <br />(FMPs) provide a water management tool that can be used for maintaining and enhancing <br />flow - related values within a given stream reach through the collaborative operation of <br />water facilities and other cooperative efforts. <br />Tier 2 Concepts under Consideration by the Stakeholder Group: <br />a. Federal Legislation: Several legislative mechanisms including special legislation, <br />Natural Recreation Areas, and National Conservation Areas are described below. These <br />strategies have similar qualities. <br />(1) National Recreation Areas require federal legislation to protect areas on federal <br />lands that are extraordinary in quality and recreation. They are intended for <br />recreational use and recognize recreation as the dominant purpose. <br />(2) National Conservation Areas require federal legislation to protect areas on federal <br />lands to conserve and protect a range of natural and other values in an area. <br />(3) Special legislation can be tailored to meet the protection needs of a particular <br />situation, and can be designed to protect a broad suite of resource values (as is the <br />case for the Rio Grande Natural Area) or can be very narrowly focused. <br />b. Plan for Augmentation to Supplement Flows: A plan for augmentation is "a detailed <br />program, which may be either temporary or perpetual in duration, to increase the supply <br />of water available for beneficial use in a division or portion thereof by the development <br />Of new or alternate means or points of diversion, by a pooling of water resources, by <br />water exchange projects, by providing substitute supplies of water, by the development of <br />new sources of water, or by any other appropriate means." C.R.S. §37 -92- 103(9) <br />(emphasis added). <br />c. Protection of Bypass Flows /Releases of Water: Under this proposal, the bypass flows <br />and releases of water from reservoirs and other sources of water would be protected <br />either as: 1) increases to or augmentation of CWCB instream flows; 2) augmentation of <br />Colorado River District Constant Flows; and /or 3) augmentation of RICD flows through <br />Gore Canyon. <br />d. Recreational In- Channel Diversions (RICDs): RICDs are in- channel water rights for <br />recreational purposes. <br />e. River District Appropriation of Water for Fish Preservation: The Colorado River <br />District's enabling legislation allows the District to file upon and hold water rights to <br />maintain stream flow needed to preserve fish. <br />f. Wild & Scenic Rivers Designation. <br />(1) Under § 2(a) (i) -- Under this approach, Congress would designate the segments <br />under the Wild and Scenic Act. <br />(2) Designation under § 2(a)(ii) -- Under this option, the Secretary of the Interior <br />may approve designation upon petition by the Governor of the State, after <br />-3- <br />
