CONTRACT AMENDMENT
THIS CONTRACT, made this 16th day of June 198 6 , by and between the
State of Colorado for the use and benefit of the Department of *1 Natural Resources
(Colorado Water Conservation Board).

WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made
available and a sufficient unencumbered balance thereof remains available for payment in Fund Number 4008
G/L Account Number 5311X , Contract Encumbrance Number C15 3 3 8 0; and
ABL Account Number 13112, Org. Unit 77 -77 -777,
WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate
agencies; and
WHEREAS, the State and the Contractor did on April 15,
1982, enter into a contract for State participation in the
improvements of the water supply system of the Contractor for
the benefit of the members of the Ute Water Conservancy
District in Mesa County, Colorado; and
WHEREAS, Senate Bill 439 (1981 Session) which authorized
the project also provided that the authorized amount of Seven
Million Five Hundred Thousand Dollars ($7,500,000) could be
increased by such amounts, if any, as may be justified
by reason of ordinary fluctuations in construction costs as
indicated by engineering cost indices applicable to the types
of construction involved for such projects . . ."; and
WHEREAS, the State staff has verified that the cost indices
for this project have increased from the time that the project
was authorized to the time the project was bid by seven and
one -half percent (7.5 %) of the project cost: and

NOW THEREFORE, it is hereby agreed hat:
A. The original contract, dated April 15, 1982 (Exhibit A),
is attached hereto and incorporated herein by reference
and is amended as follows:
Paragraph A.12. shall read:
Purchase from the State all of the State's right,
title, and interest in said project and any facilities
thereof at a total purchase price of Fifteen Million Five
Hundred Thirty -Five Thousand Two Hundred Eighty -Four
Dollars ($15,535,284), payable in thirty (30) annual
installments as follows:
a. First through third installments shall be Four
Hundred Eighty -Seven Thousand Eight Hundred Eighty
Dollars ($487,880) each.
b. Fourth through thirtieth installments shall be Five
Hundred Twenty -One Thousand One Hundred Seventy -Two
Dollars ($521,172) each.
The first installment shall be due and payable on April
15, 1984, and other installments yearly thereafter until
