3. Require all Subcontractors to indemnify the State and <br />the Contractor against all liability and loss, and against all <br />claims and actions based upon or arising out of damage or injury, <br />including death, to persons or property caused by or sustained in <br />connection with the performance of any subcontract or by <br />conditions created thereby, or based upon any violation of any <br />statute, ordinance, or regulation, and the defense of any such <br />claims or actions. <br />4. Require all Subcontractors to maintain liability <br />insurance in at least the following amounts: <br />a. For any injury to one person in any single <br />occurrence, the sum of One Hundred Fifty Thousand <br />Dollars ($150,000). <br />b. For any injury to two or more persons in any single <br />occurrence, the sum of Four Hundred Thousand Dollars <br />($400,000). <br />Said liability insurance shall name the Contractor and <br />the State as co- insureds. No payments shall be made under this <br />contract unless a copy of a certificate of said liability <br />insurance has been filed with the Colorado Water Conservation <br />Board. <br />5. Convey or cause title to be conveyed by deed or other <br />proper conveyance to the Colorado Water Conservation Board, <br />Department of Natural Resources, State of Colorado, the following <br />portions of the proposed project facilities within thirty (30) <br />days of their completion: <br />a. A five - million - gallon steel water storage tank <br />about 146 feet in diameter, 40 feet high, with all <br />appurtenances. <br />b. 1800 + feet of 24 -inch steel pipe connecting the <br />tank to a main water transmission lin caned by the <br />District. <br />c. An altitude valve and vault. ` <br />d. A steel chainlink fence enclo'Ving, ank site. <br />e. Yard piping. .; <br />All of the above are to be located on a mesa,�pproximately 8 <br />miles southeast from Grand Junction in the southeast quarter of <br />Section 25, VS, ME, Ute Principal Meridian, with a tank floor <br />elevation at 5022 feet above mean sea level, all as shown in <br />Appendix A. <br />f. A twenty- two - million - gallon - per -day plus or minus <br />(22 + mgd) water treatment plant with all associated <br />and appurtenant facilities as shown below: <br />(1 ) A new wing along the side of the existing <br />operations building 90'x45'. <br />(2) A new chemical feeder room on second level of new <br />wing. <br />(3 ) Expanded control room area, new office, operator's <br />laboratory, men's lockers, showers, and vestibule. <br />(4) Two new filters of 465 square feet media area with <br />provision to expand.in the future. <br />Page 2 of 8 Pages <br />
