Form 6- AC -02A <br />DEPA NT OR AG NCY NUMBER <br />34 -v4 -00 <br />CONTRACT ROUTING NUMBER <br />no encumbrance <br />CONTRACT AMENDMENT <br />THIS CONTRACT, made this lst day of January 1982, by and between the <br />State of Colorado for the use and benefit of the Department of .t Natural Resources <br />(Colorado Water Conservation Board), <br />hereinafter referred to as the State, and -2 Ute Water Conservancy District, <br />P. 0. Box 460, Grand Junction, CO 81501, <br />hereinafter referred to as the contractor, <br />WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made <br />available and a sufficient unencumbered balance thereof remains available for payment in Fund Number. <br />G/L Account Number 5 3117, Contract Encumbrance Number C 15 3 3 2 9, and <br />WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate <br />agencies; and <br />WHEREAS, the State and the Contractor did on September 15, <br />1980, enter into a contract for State participation in the <br />construction of the Ute Water Conservancy District project for <br />the benefit of the members of the District in Mesa County, <br />Colorado, which contract is attached hereto as Exhibit A and <br />hereby incorporated herein; and <br />WHEREAS, the project described in that certain contract of <br />September 15, 1980, was constructed with less money than what <br />was originally estimated by the engineer; and <br />WHEREAS, the Contractor wishes to spend the remaining <br />money made available in that certain contract of September 15, <br />1980, to construct an additional portion of the project; <br />NOW, THEREFORE, in consideration of the mueetu d <br />dependent covenants herein contained, it is agrthe <br />parties hereto as follows: <br />1. The terms and provisions of paragraph A. ain <br />contract dated September 15, 1980, attached h hibit A <br />and incorporated herein by reference shall no 1 e <br />effective but shall be amended to read as fo;Cq!!1k <br />A.2. Convey or cause title to be conveye by deed or <br />other proper conveyance to the State the following <br />portions of the proposed project facilities: <br />a. A five- million- gallon water tank with all <br />appurtenances to be located within 4.839 acres of land, as <br />described in Appendix A <br />b. 4.839 acres of land, as described in Appendix A <br />C. A 24 -inch diameter steel pipe, 2690 + feet in length, <br />with all appurtenances <br />d. An altitude valve and vault connected to the system <br />e. A 12 -inch diameter asbestos cement pipe, 284 + feet in <br />length, with all appurtenances <br />f. A 24 -inch diameter steel yard pipe, 64 + feet in <br />length, with all appurtenances <br />All items in c to f are located in Section 19, VS, R1W, <br />Ute Principal Meridian, South of the Colorado River in the <br />Redlands, as shown in Appendix B. <br />Page 1 of 4 pages <br />*(See instructions on reverse of last page.) <br />4 <br />
