Existing Water Right Information <br />Staff has analyzed the water rights tabulation and contacted the Division Engineer Office (DEO) <br />to identify any potential water availability problems. There are no decreed surface diversions <br />within this reach of stream. Staff has determined that water is available for appropriation on <br />Middle Creek, between the headwaters and the confluence with Ophir Creek, to preserve the <br />natural environment to a reasonable degree without limiting or foreclosing the exercise of valid <br />existing water rights. <br />CWCB Staffs Instream Flow Recommendation <br />Staff recommends the Board form its intent to appropriate on the following stream reach: <br />Segment: Headwaters to Confluence with Ophir Creek <br />Upper Terminus: HEADWATERS IN THE VICINITY OF <br />(Latitude 380 02'44.30"N) (Longitude 1050 10'31.31"W) <br />UTM North: 4210893.34 UTM East: 484613.10 <br />NW SW S13 T23S R70W 6th PM <br />165' East of the West Section Line; 2330' North of the South Section Line <br />Lower Terminus: CONFLUENCE WITH OPHIR CREEK <br />(Latitude 38° 03' 55.58 "N) (Longitude 105006'20.10"W) <br />UTM North: 4213080.93 UTM East: 490738.21 <br />NW NE S9 T23S R 69W 6th PM <br />1300' West of the East Section Line; 1290' South of the North Section Line <br />Watershed: Upper Gunnison (HUC #: 14020002) <br />Counties: Custer <br />Length: 4.78 miles <br />USGS Quad(s): Deer Peak, St. Charles Peak <br />Flow Recommendation: 3.4 cfs (April 15 — June 30) <br />2.0 cfs (Julyl —August 31) <br />1.0 cfs (September 1 — April 14) <br />-7- <br />
