DRAFT - 9/26/01 <br />SECWCD - AURORA IGA <br />(M &I) "within and outside the boundaries" of the District is under review, and "that it is possible <br />that Reclamation will conclude it lacks the authority for all or some of such contracts;" <br />Whereas, the Parties to this IGA wish to resolve these issues between them in a mutually <br />beneficial fashion; and <br />Whereas, this IGA is intended to serve as the IGA referenced in the proposed amendment <br />to H.R. 1714 attached hereto. <br />III. Purposes <br />The purposes of this IGA are to agree upon and implement terms: <br />A. for amending H.R. 1714 to provide authorization for the specific purpose of <br />Aurora's contracting for if -and -when available storage and exchange use of excess capacity in <br />current Fry -Ark Project facilities in accordance with this IGA, for cooperation in efforts to pass <br />H.R. 1714 as so amended or any companion or successor legislation, and for Aurora's <br />contracting for and use of Fry -Ark Project facilities pursuant thereto; <br />B. creating a framework within which Aurora and Southeastern will proceed toward <br />settling their opposition to Water Court applications filed by each other; <br />
