Aurora will, consistent with its overall system -wide water operations, make the <br />water available for any remainder of the five -year period following a drought as soon as <br />reasonably possible considering its system -wide demands and supplies. <br />D. Payment Requirements <br />Aurora shall pay to Southeastern, or to the Southeastern Colorado Water <br />Activity Enterprise, in Southeastern's sole discretion, the following sums: <br />a. $1,000,000 for water facilities development, construction, and <br />engineering services, and /or contracting, financing and administration services, <br />upon execution by Aurora and Reclamation of a five -year or longer contract for <br />use of Fry -Ark facilities following enactment of, and consistent with, <br />authorization as provided in Section IV.A. above; and <br />b. A total of $1,250,000 for contracting, financing and administration <br />services and /or operation, maintenance and replacement services, payable in <br />annual installments of $50,000 per year on the first day of February in each and <br />every year, for 25 years beginning when (i) the legislation described in Section <br />IV.A. above is enacted, and (ii) Southeastern has consented to entry of a decree in <br />Case Nos. 99CW169 and 99CWI70. <br />C. Southeastern and Aurora intend that the proceeds from the <br />payments Southeastern receives pursuant to subparagraphs La and Lb should be <br />25 <br />
