12 <br />46.E A database for gravel mining operations is maintained at the State Engineer's Office. This <br />database includes information about the mining operation including, but not limited to, <br />applicant, Division of Minerals and Geology status, mine name and location, well permit <br />status, substitute water supply plan and augmentation plan status, and field inspections. <br />47. In any substitute water supply _plan approval, the decision of the state engineer shall <br />have no precedential or evidentiary force, shall not create any_preg4nptions, shift <br />the burden of proof, or serve as a defense in any water court case or any other legal <br />action that may be initiated concerning the substitute water supply plan. This <br />decision shall not bind the State Engineer to act in a similar manner in any other <br />applications involving other plans or in any proposed renewal of this plan, and shall <br />not imply concurrence with any findings of fact or conclusions of law contained <br />herein, or with the engineering methodologies used by the Ap hp cant. <br />48.36: -These guidelines are conditional for five years and will be subject to reevaluation. <br />Gravel Pit SSP Guidelines.doc (Last Update F 96Aumt 30.2004) <br />
