1. <br />C <br />31. In accordance with amendments to Section 625 -8- 202 47). C.R.S. and "Senate Bill <br />89 -181 Rules and Regulations" adopted on February 4, 1992, the State Engineer shall <br />determine if this substitute water supply plan is of a quality to meet requirements of <br />use to which the senior appropriation receiving the substitute supply has normally <br />been put. As such, water quality data or analyses may be Muested at any time to <br />determine if the requirement of use of the senior appropriator is met. <br />OPERATION OF PLAN <br />32.23 -Each plan shall include a detailed accounting sheet providing monthly estimates of the <br />following items: pit size, water surface area, gross evaporation, net mplae°m , amount <br />ofen mined material, water removed with the mined sand and gravel, diversions for dust <br />control, diversions for vegetation establishment, total lagged depletions impacting the river, <br />reservoir or replacement source releases, physical flow available at the surface water right <br />headgate, historical consumptive use credit estimate, rate and volume of dewatering and <br />transportation loss charges. All items in this list may not be applicable to every proposal. <br />Likewise, certain proposals may require additional accounting. A draft accounting form <br />shall be submitted to the State Engineer for approval. The substitute water supply plan shall <br />provide the name, address and telephone number of the contact person who will be <br />responsible for the accounting and operation of this plan. The State Engineer's Office will <br />hold the permit designee of the operation as filed with the Division of Minerals and <br />Geology responsible for compliance but reserves the right to also pursue the landowner for <br />eventual compliance. <br />33.24: Accounting and reporting of depletions and replacements shall be made monthly to the <br />division engineer and water commissioner. More frequent accounting may be required by <br />the division engineer to protect other water users. Reservoir releases may also be <br />aggregated at the division engineer's discretion for maximum benefit of the stream system. <br />34.2-3 -- Adequate flow measuring devices and measurements may be required to implement the <br />plan. Measurements may include, but shall not be limited to, all diversions from the pit <br />(excluding evaporation), water released from reservoirs or other sources for replacement <br />water, and the diversion and turn back of ditch diversions. <br />35.2-6- A plan will not be approved unless the applicant has also applied for a gravel well permit <br />for the subject pit. A gravel well permit will not be issued until the substitute water supply <br />plan is approved. Additionally, if another well is located within 600 feet (1/2 mile for <br />designated basins) of the perimeter of the proposed free water surface, a waiver of objection <br />form eens 4-ef-the well owners) must be obtained or a heat ng before the State E-H-i , <br />to deter . If the applicant cannot obtain a waiver of <br />objection from the owners of wells located within 600 -feet of the free water surface, the <br />State Engineer's Office shall notify the well owners in accordance with C.R.S. 37-90 - <br />137(2(b)(I&A).
