The historical consumptive use credit may be assigned to precipitation or ground water. <br />The amount of consumptive use credit from precipitation and ground water during the <br />growing season cannot exceed the total potential consumptive use of the native vegetation. <br />No benefit is given for excess consumptive use credits. The net depletion will be calculated <br />as gross evaporation minus historical consumptive use. The historical consumptive use for <br />non - irrigated native sites without phreatophytes or subirrigation is equal to the effective <br />precipitation, which is equal to 70% of total precipitation for each month. Higher <br />maximum effective precipitation amounts must be supported with engineering <br />documentation. The maximum effective precipitation must be adjusted accordingly for <br />sites with historical irrigation or subirrigation. <br />16. For avel pits that are lined in accordance with the State Engineer's Lining Criteria, the <br />Mlicant must replace depletions from all water consumed within the lined area except for <br />the water removed in product. <br />17. In accordance with the State Engineer's Office Policy 2004 -3, phreatophyte credit, <br />including effective precipitation, cannot be claimed for an off channel lined gravel pit which <br />is used as a storage reservoir. <br />18. Plans approved for sand and gravel mining_ operations cannot be used to replace depletions <br />that occur from uses that are not directly related to the mining operation. The plan cannot <br />replace depletions from uses that occur outside the mining permit boundarL unless the <br />applicant can show to the satisfaction of the State Engineer's Office that the use is directly <br />related to the gravel mining operation. <br />REPLACEMENT SOURCES <br />19.4121- Replacement water to compensate out -of- priority depletions must be available either <br />directly or by exchange in the proper quantity, quality, place and time to insure that <br />existing water rights are not injured. All plans, whether- the pit has ° se • ater- ^ a , <br />submitted to this office will be required to have concurrent replacement water available in <br />order to obtain approval from the State Engineer. <br />20.E Plans for replacement generally utilize #wee -four primary sources of water to compensate <br />the stream system for depletions resulting from evaporation and mining losses. These <br />sources include direct flow water rights, reservoir storage, nontributary and transbasin <br />water, and leased reusable effluent. Water right decrees and other pertinent information <br />regarding the replacement sources shall be included. The applicant shall also provide <br />signed lease agreements or recorded non - encumbered ownership documents authorizing use <br />of the proposed replacement sources. Although the substitute water supply plan may be <br />approved on a temporary basis using leased or nontributary water for the replacement water, <br />this office may object to the use of these sources in a proposed decreed plan for <br />augmentation. The decision to accept these sources as adequate to protect the senior water <br />rights may be determined by the Water Court in which the plan is filed. <br />
