Hall, Pitts & Associates <br />\ CONSULTING ENGINEERS <br />June 8, 1994 <br />MEMO TO: Tommy Thomson <br />Eric Kuhn <br />Peter Evans' <br />FROM: Tom Pitts <br />SUBJECT: USFWS Proposal for Ruedi Reservoir Releases to <br />Offset Critical Habitat Designation <br />During the Recovery Program Management Committee conference <br />call on June 6, USFWS representative Larry Shanks updated the <br />Committee on the status of the Service's recommended changes <br />to the Recovery Action Plan ( RIPRAP) to offset critical <br />habitat. Shank stated that the Service had adopted the <br />Bureau's approach, i.e., releases of uncommitted water from <br />Ruedi after Round II water sales would be required until Ruedi <br />water could be replaced with water from other sources. This <br />was contrary to the recommendation of the Recovery Program <br />Management Committee to the Service (see my memo to Eric Kuhn <br />dated May 23, 1994). <br />Pursuant to our conference call (Thomson /Evans /Pitts) of June <br />8, I contacted John Hamill to get the exact language the <br />Service is proposing to use in the RIPRAP that will be <br />available pursuant to the Federal Register notice. That <br />language is as follows: <br />"After Ruedi Round II water sales are completed or <br />commitments to contracts agreed to, enter into agreement <br />for remaining uncommitted water from Ruedi Reservoir." <br />This language does not include any reference to replacement <br />water. I explained our concerns to Hamill and he acknowledged <br />them. The Service wishes to have this water replaced before <br />it is made available for other uses. He stated the example <br />that if the Bureau wanted to use this water for other <br />purposes, this would require the Service's permission or <br />replacement water would have to be provided.
