permanent allocation of all uncommitted Ruedi Reservoir water for endangered species flow <br />enhancement purposes. " I remain concerned that this discrepancy between the Colorado/Water <br />User position and Reclamation's position has given the FWS considerable latitude in crafting its <br />recommendation. <br />The FWS is now indicating a desire to enter into an agreement with Reclamation for'all <br />of the uncommitted Ruedi Reservoir water after the Round II sales for fish recovery flow <br />enhancement purposes until alternative supplies are committed to the full extent of their flow <br />recommendations for the 15 Mile Reach. <br />On June 20, 1994 the FWS published a notice in the federal register announcing the <br />availability of the documents which describe these recommended changes to the Recovery Action <br />Plan, and initiating a 45 -day public review and comment. A copy of the notice submitted by the <br />FWS to the Federal Register is attached for your review. That 45 -day period closes on about <br />August 5, 1994. <br />In consultation with staff from the Colorado Department of Agriculture, Colorado <br />Division of Wildlife, and Colorado Water Conservation Board (as well as other interested <br />parties), I plan to assemble an integrated set of comments to submit to the FWS within the <br />established time frame. I also plan to request guidance from the Attorney General's Office <br />regarding the proposed commitment of Ruedi Reservoir water in a manner _which may be <br />contrary to the authorized project purposes.
