14. The Grantee shall take necessary precautions to prevent pollution
<br />or deterioration of lands, air, or waters which may result from the
<br />exercise of the privileges extended by this grant. The Grantee
<br />shall be responsible for securing any permits, certificates,
<br />licenses, or other forms of approval required to comply with Federal
<br />and State standards for public health and safety, environmental pro-
<br />tection, siting, construction, operation, or maintenance.
<br />15. Before water is stored in the reservoirs, the Grantee shall construct
<br />and install a log boom above the-emergency and mechanical spillways
<br />in a position acceptable to the Forest Service. Boasts shall be of
<br />sound material, constructed according to specifications as estab-
<br />lished or approved by the Forest Supervisor.
<br />16. Any lands described in this easement which have been withdrawn for
<br />waterpower purposes under the act of March 3, 1879, or act of
<br />June 25, 1910 (or are embraced in an application or license under
<br />the Federal Power Act of June 10, 1920), or have been withdrawn
<br />under the Reclamation Act of June 17, 1902, are subject at any time
<br />to use in connection with the development of waterpower or for
<br />reclamation purposes. This easement, therefore, is issued with the
<br />specific understanding that (1) its use shall not interfere with
<br />such waterpower or reclamation development and that (2) the ease-
<br />ment may be, if necessary, terminated upon ninety (90) days notice
<br />when the judgment of the Federal Energy Regulatory Commission, or
<br />of the Bureau of Reclamation in the event of reclamation
<br />withdrawals, the lands occupied are needed for use in connection
<br />with the generation of hydroelectric power, reclamation develop-
<br />ments, or other purposes contemplated by the act or acts under
<br />which the lands have been withdrawn. No claim shall be made
<br />against the Grantor or power licensees for or on account of
<br />prospective profits or for any injury or damage to properties,
<br />improvements, or operations due to such development. The Grantee
<br />will be allowed ninety (90) days in which to remove his improve-
<br />ments.
<br />-1100 This easement is issued subject to the provisions of the Boulder
<br />Canyon Project Act of December 21, 1928 (45 Stat., 1064), particu-
<br />larly Section 13, and to the provisions of the Upper Colorado River
<br />Compact.
<br />18. A comprehensive boating safety plan shall be jointly prepared by
<br />the Grantee and the Forest Officer in charge and the provisions
<br />thereof will be executed and enforced by the Grantee. This plan
<br />shall be reviewed annually and revised as needed. It will include
<br />consideration of all hazards involved in the use and enjoyment of
<br />the granted area and lake facilities. It will include provisions
<br />for adequate instructions, signs, warnings, signals, banners, buoys,
<br />and other safety precautions necessary to provide public safety
<br />regarding mechanical equipment and other sources of personal
<br />injury.
<br />19. To provide and maintain public recreation opportunities, the
<br />Grantee shall annually prepare a release schedule for Hog Park
<br />Reservoir and Rob Roy Reservoir for approval by the Forest Super-
<br />visor. The Grantee shall implement and follow the release schedule
<br />as approved.
<br />00 To provide and maintain favorable conditions of waterflows, the
<br />Grantee shall:
<br />a. Release an instantaneous minimum flow of 15 cubic feet per
<br />secon3-(cfs) from the Hog Park Reservoir outlet at all times.
<br />b. Control maximum releases through the Hog Park Reservoir cutlet
<br />works so as not to exceed 200 cfs at any time except that the
<br />natural flow may be'released if it exceeds 200 cfs.
