3. State facts why Application for water rights should not be granted or
why it should be granted only in part or on certain conditions:
(a) Colorado River Water Conservation District is the owner and claimant
of water rights on the Little Snake River and on the Yampa River. The
Colorado River Water Conservation District is also the owner and claimant
of appropriations of water from the Colorado River and its tributaries.
(b) The Applicant has not initiated a valid appropriation of water for
Three Forks Reservoir pursuant to Colorado Law.
(c) The Applicant has not formed the requisite intent to appropriate
water nor has the Applicant taken the necessary first step to initiate
a lawful appropriation pursuant to Colorado Law.
(d) The proposed appropriation.of the Applicant for Three Forks Reservoir
is contrary to the provisions of the Upper Colorado River Basin Compact,
C.R.S. 1973, 37 -62 -101 et seq.
(e) Applicant's proposed diversion of water from the State of Colorado
would cause injury to water rights of the Colorado River Water Conservation
District and other owners of water rights in the State of Colorado.
