UNUSED FUNDS <br />13. In the event that any funds advanced to Reclamation are not <br />required to complete the work program, such excess funds shall be <br />returned by Reclamation to the Cooperating Partners in the same <br />proportion that they were advanced, within.60 days of completion <br />of the Program Plan or of the termination date specified in <br />Section 14, whichever is earlier. <br />TERMINATION <br />14. a. Action to terminate this Agreement within 180 days of <br />execution of this Agreement may be taken only by a unanimous vote <br />of all the Cooperating Partners. <br />b. Beginning 181 days after execution of this Agreement, <br />any of the Parties may terminate this Agreement effective 30 days <br />after delivery to the other Parties of written notice of <br />termination. <br />AVAILABILITY OF INFORMATION <br />15. a. All information and data obtained or developed by <br />Reclamation, in connection with development of the Program Plan <br />(exclusive of intra- governmental communications) shall be <br />available upon request, except where prohibited by law, to the <br />Cooperating Partners, and Steering Committee members without <br />further charge. However, use of said reports, data, and <br />information shall appropriately reference Reclamation as the <br />source. <br />b. All parties recognize that the information developed, <br />exclusive of intra- governmental communications, is public <br />information and available for release upon request. <br />JURISDICTION <br />16. Federal and State laws govern this Agreement. In case of <br />conflict between Federal and State law,- Federal law controls. <br />JUDICIAL REMEDIES NOT FORECLOSED <br />17. Nothing herein shall be construed as: (a) depriving any <br />Party from pursuing and prosecuting any remedy in any appropriate <br />court of the United States or appropriate State which would <br />otherwise be available to such Parties even though provisions <br />herein may declare that determinations or decisions of <br />7 <br />
