PARTIES <br />This Contract (hereinafter called "Contract') is entered into by and between Terrace Irrigation Company Inc., <br />located at PO Box 109, Monte Vista, CO 81144, (hereinafter called "Contractor "), and the STATE OF <br />COLORADO acting by and through the Department of Natural Resources Colorado Water Conservation Board, <br />located at 1313 Sherman ST #723, Denver, CO 80203 (hereinafter called the "State" or "CWCB "). Contractor <br />and the State hereby agree to the following terms and conditions. <br />2. EFFECTIVE DATE AND NOTICE OF NONLIABILITY <br />This Contract shall not be effective or enforceable until it is approved and signed by the Colorado State <br />Controller or designee (hereinafter called the "Effective Date "). The State shall not be liable to pay or reimburse <br />Contractor for any performance hereunder including, but not limited to, costs or expenses incurred, or be bound <br />by any provision hereof prior to the Effective Date. <br />3. RECITALS <br />A. Authority, Appropriation, and Approval <br />Authority to enter into this Contract exists in CRS 37 -60 -121 (3)(a)(b) and funds have been budgeted, <br />appropriated and otherwise made available and a sufficient unencumbered balance thereof remains <br />available for payment. Required approvals, clearance and coordination have been accomplished from and <br />with appropriate agencies. <br />Rev 7/7/11 <br />
