F <br />1 arrived at terms and conditions. So if there is some ambiguity <br />2 built into the decree or some problem with the langauge, I don't <br />3 think it would be entirely fair to attribute that ambiguity to <br />4 the court; it was a stipulation. <br />5 MR. HOWLAND: Mr. Cooley, one more time, please. <br />6 MR. COOLEY: Yes, Bill. <br />7 MR.: HOWLAND : I don't want to enter into an <br />8 argument with my friend, Mr. Schroeder, but I believe the decree <br />9 also stipulates that the court will have a continuing review. <br />10 process of that decree. I haven't seen it in quite some time, <br />11 but it seems to me that it is still an open -ended decree. Isn't <br />12 that so? <br />13 I don't care, I am asking either one of you. <br />14 MR, COOLEY: It retains jurisdiction. <br />15 <br />MR. SCHROEDER: <br />Well, the <br />decree provides that <br />16 <br />it is interlocutory until such <br />time as those required gaging <br />17 <br />stations are installed. Once the gaging <br />stations are installed, <br />18 <br />the interlocutory provision is <br />no longer <br />in effect and is at <br />19 <br />that point a decree that is subject to the jurisdiction and <br />20 <br />administration of the division <br />engineer. <br />I am unaware of any <br />21 <br />further provisions for review. <br />22 MR.
