ISSUES PRESENTED FOR REVIEW <br />Whether the decision of the Executive Director of the Colorado <br />Department of Personnel implementing a classification system change <br />adopted by the Colorado Department of Personnel, which resulted in <br />the lowering of Plaintiffs' salaries, was arbitrary and capricious, <br />exceeded the Director's statutory jurisdiction, was in violation of <br />the statutory and constitutional rights of Plaintiffs, or was <br />otherwise contrary to rule of law. <br />STATEMENT OF THE CASE <br />A. Nature of the Proceedings, Course of Proceedings, and <br />Disposition Below <br />This matter was brought before the Denver District Court for <br />review pursuant to C.R.S. §24 -4 -106 (1997), and C.R.S. §§24 -50- <br />104(3)(g) and (4)(d)(I)(1997), by the filing of complaints to <br />review the decision of Defendant Executive Director of the Colorado <br />Department of Personnel ( "Director's Decision "). The Director's <br />Decision affirmed changes adopted by Defendant Colorado Department <br />of Personnel ( "Department ") under the auspices of the job <br />evaluation system which reduced in grade the salary of the <br />Environmental Protection Specialists (EnPS) and Physical Science <br />Researcher /Scientists (PSR /S).
