Colorado Water Conservation Board <br />Case No. 02CW038, Water Division 4; Concerning the Application for Water Rights of the Upper Gunnison River Water <br />Conservancy District, in the Gunnison River, in Gunnison County, Colorado <br />Prehearing Statement of Colorado River Water Conservation District <br />Page 4 of 5 <br />The CRWCD representative may testify regarding the history of the Subordination <br />Agreement; the CRWCD's role in negotiating and executing the Subordination Agreement; the <br />intent of the Subordination Agreement; the depletions that have occurred pursuant to the <br />Subordination Agreement; the CRWCD's concerns relating to the implementation of the <br />Subordination Agreement; the importance of full development of the full 60,000 acre foot depletion <br />allowance; and historical reservoir and exchange operations under the 1975 Exchange Agreement. <br />B. A representative of the United States of America, Department of Interior, U.S. Bureau of <br />Reclamation, 2764 Compass Drive, Suite 106, Grand Junction CO 81506. <br />The Bureau of Reclamation representative may testify regarding the history of the <br />Subordination Agreement; the Bureau's role in negotiating and executing the Subordination <br />Agreement; and the intent of the Subordination Agreement. <br />C. A representative of the Colorado State Engineer's Office, Colorado Division of Water <br />Resources, 1313 Sherman.-) treet, Room 818', Denver, CO 80203. <br />The State Engineer's Office representative may testify regarding the history of the <br />Subordination Agreement; the Division of Water Resource's role in negotiating and executing the <br />Subordination Agreement; and the intent of the Subordination Agreement. <br />D. Wayne Schieldt, Division Engineer for Water Division No. 4, 1871 East Main Street, P.O. <br />Box 456, Montrose, CO 81401. <br />Mr. Schieldt may testify regarding the same information as the representative of the State <br />Engineer's Office. In addition, Mr. Schieldt may testify regarding the depletions that have occurred <br />pursuant to the Subordination Agreement and the potential effects of the UGRWCD's RICD on the <br />full development of 60,000 acre feet of depletions pursuant to the Subordination Agreement. <br />E. The CRWCD reserves the right to examine or cross - examine witnesses identified by other <br />parties and to designate additional witnesses for purposes of rebuttal. <br />V. POSSIBLE EXHIBITS <br />A. Agreement among the United States of America, the Colorado State Engineer, the Colorado <br />River Water Conservation District, and the Upper Gunnison River Water Conservancy <br />District for the Administration of Water Pursuant to the Subordination of Wayne N. Aspinall <br />Unit Water Rights Within the Upper Gunnison River Basin, dated June 1, 2000. <br />
